Description
This notice is provided on a sole source basis, with an intent to award a firm- fixed price order with Linvatec Corporation. This is a combined synopsis/solicitation for commercial items, prepared in accordance with the format in FAR subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation, quotations are being requested and a written solicitation will not be issued. The solicitation number, N00259-02-T-0039, is issued as a request for quotations(RFQ). The solicitation document and incorporated provisions and clauses are those in effect through FAC 2001-07. Item 0001: INDEFINITE DELIVERY TYPE PURCHASE ORDER (IDTPO) FOR THE OFF- SITE REPAIR SERVICE AND SUPPORT FOR RIGID ENDOSCOPES IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF STATEMENT OF WORK. THE PERFORMANCE PERIOD IS FROM 15 JUNE 2002 TO 30 SEPT 2002. NAME: RIGID ENDOSCOPE, 1.9MM, 2.5MM, 2.7MM, 4MM POC: SH2 BUENAVENTE, TEL: 2-8016. The Statement of Works reads: Naval Medical Center San Diego, as customer agrees to send all of its rigid endoscopes, excluding small joint (2.4mm) scopes, to contractor for repair and contractor agrees to send to Customer replacement endoscope for a fixed fee. If contractor provides a replacement endoscope within two (2) business days of being notified by customer that an endoscope needs repair, Customer will pay the fee stated below. If the replacement scope is not received by Naval Medical Center San Diego within (2) business days after notification, the government will not be charged, provided, however, that the damaged endoscope is returned to contractor and that delivery delays due to force majeure (e.g. natural disasters, strikes or other circumstances beyond contractor?s control) will not excuse the government paying the fee. Procedure: 1. Naval Medical Center San Diego will notify contractor Customer Service (at 800-237-0169) when a scope is damage and replacement is requested. 2. Linvatec Customer Service will issue a Return Goods (RG) number to the customer, and instruct Customer to return the damaged endoscope to a designated contractor?s Authorized Repair Facility. Naval Medical Center San Diego will, at its expense, send the damaged endoscope to the designated Repair Facility. 4. Contractor will, upon issuance of the RG number, invoice the customer for $895.00 although, upon receipt of the Government damaged endoscope, and verification that it is covered by this agreement and not covered under contractor?s warranty, contractor will credit the Government $895.00. 5. If the damaged endoscope is covered by contractor?s warranty, Government will be credited $895.00. A credit will not be issued to Government if the damaged endoscope is not received by the designated Repair Facility within (30) days from the shipping date of the replacement endoscope. This acquisition incorporates the following FAR clauses: 52.212-1 INSTRUCTIONS TO OFFERORS-COMMERCIAL ITEMS(Oct 95); FAR 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS-COMMERCIAL ITEMS (Oct 95) must be completed and submitted along with the quote (please contact Loida Toledo at (619)532-8122 if a copy is needed; in accordance with FAR 52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS-COMMERCIAL ITEMS(Aug 96), the following clauses are incorporated by reference in paragraph (b): 52.222-26 EQUAL OPPORTUNITY ( E.O. 11246); 52.222-35 AFFIRMATIVE ACTION FOR SPECIAL DISABLED AND VIETNAM ERA VETERAN (38 U.S.C. 4212); 52.222-37 EMPLOYMENT REPORTS ON SPECIAL DISABLED VETERANS AND VETERANS OF THE VIETNAM ERA(38 U.S.C. 4212); 52.222-36 AFFIRMATIVE ACTION FOR HANDICAPPED WORKERS(29 U.S.C. 793); 52.212-4 CONTRACT TERMS AND CONDITIONS COMMERCIAL ITEMS(OST 95). DFARS 252.204-7004, REQUIRED CENTRAL CONTRACTOR REGISTRATION (MAR 1989); FAR 52.212-2 , EVALUATION -COMMERCIAL ITEMS( 1/99); FAR 52.222-48 , EXEMPTION FROM APPLICATION OF SERVICE CONTRACT ACT PROVISIONS (MAY 1989). The following factors shall be used to evaluate offers: 1) Past performance, 2) technical capabilities, 3) Price. Past performance and Technical capabilities when combined have more importance than cost or price. Interested contractors aside from Linvatec, for past performance evaluation, provide at least 3 sources that we may contact which you have provided the same type of service. All responsible sources may submit a proposal which shall be considered. See number note(s) 22.
