Description
Description: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 and the test program in FAR Subpart 13.5, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation or Request for Quote (RFQ) and will follow simplified acquisition procedures. Responses are requested pursuant to this announcement. All responses shall reference Solicitation 163P02200849. This solicitation incorporates all of the applicable provisions and clauses in effect through FAC 01-08, as if stated in full text, as well as the terms and conditions of FAR 52-212-1. The United States Patent and Trademark Office (USPTO) anticipates awarding multiple purchase orders as a result of this solicitation. This procurement is set aside for small business. The North American Industrial Classification Code System (NAICS) code for this procurement is 422920. For this NAICS a small business is not to exceed 100 employees. Background: The USPTO Scientific and Technical Information Center (STIC) provides research tools to the patent examining corps. The patent examining corps uses non-patent literature to keep abreast of trends and advances in areas related to patent examination and to help determine the patentability of inventions. A part of that research requires the review of current and historical literature in varied fields of patent invention and current and historical trends through standard references, handbooks, textbooks, and general desk references. Not all of these materials are available in electronic format. STIC procures hard copy titles through the FEDLINK Basic Ordering Agreement. FEDLINK delivery times and availability vary. STIC has committed to book delivery to patent examiners within 10-14 business days of the receipt of the request. This complies with the core of the USPTO Strategic Plan to improve patent pendency and the efficiency of the agency. The requested service will contribute to the Strategic Plan and help patent examiners meet targeted congressional and agency goals. It is imperative that delivery of books be timely. STIC will continue to use FEDLINK as the primary and preferred source for all requests. STIC will determine when FEDLINK is not able to meet the requirement. Objective: The USPTO STIC plans to acquire ordering services that will provide rush delivery of all in-print literature, and prompt delivery of rare, foreign, and out-of-print titles that are not otherwise available through FEDLINK. This procurement is set aside for small business. The intended procurement method is un-priced purchase orders as described in FAR 13-302-2. These purchase orders will be awarded on a not-to-exceed basis with a maximum performance period of one base year and four option years. Subject to adjustment, the realistic monetary limitation per book/item is $130.00. Price will be established at the time of issuance of each individual request to the vendors. Price reasonableness will be ensured through comparison between vendor price schedules available through the vendors? online search tool. The following ordering procedures will be used: -Designated and authorized Contract Officer Technical Representatives (COTR) will review the requirement and determine need for rush, out of print, rare, or foreign book delivery services. -Orders will be compiled and prices will be evaluated online through viewing each vendor s online search tool. -COTR will place the order with the vendor who represents the best value in terms of price and delivery schedule. Technical Requirements: The USPTO desires to acquire services that best meet the following requirements. -Vendors must be able to deliver in-print titles within 2-3 business days of the date of request. -Rare, out-of-print, and foreign titles must be delivered within 10-14 days of the request date. -Vendors must have an established online search tool that shows product availability and price schedule by ISBN. -If an ordered title is not in stock or is not available, the vendor must notify the USPTO within 3 days of the order. Evaluation: The USPTO will award to the responsible offerors whose offers conform to the solicitation, are the most advantageous, and represent the best value to the Government, price and other factors considered. The following factors will be used to evaluate offers: (A) Technical Capability; (B) Past Performance; and (C) Price. Factor A is more important than factor B, and together Factors A and B are more significant than Factor C. Provided below is the list of evaluation criteria: A) Technical Capability: The proposed service shall demonstrate the following: Vendors must be able to deliver in-print titles within 2-3 business days of the date of request. The offeror shall provide a detailed plan describing the resources to be utilized in performance of the service. Rare, out-of-print, and foreign titles must be delivered within 10-14 days of the request date. The offeror shall provide evidence that the company has the corporate resources and qualifications to be able to provide this service. Vendors must have an established online search tool that shows product availability and price schedule by ISBN. This search tool must be functional 24 hours a day and 7 days a week. (B) Past Performance/Experience: The offeror should have high acceptance, delivery service, and experience in the in-print, rush, out-of-print, rare, and foreign literature delivery market. The company should have a strong history in book and periodical delivery for a wide range of materials and subject matter. (C) Price: The USPTO will evaluate price by using a sample list of titles from previous orders and viewing the published price lists from the vendor s online search tool. Instruction to Offerors: -Offerors are requested to submit one (1) signed and dated response. -The response shall be brief and concise and shall demonstrate the vendor s ability to provide the proposed services. -Offerors are requested to submit a one-page past performance statement stating all relevant work experience. -Offerors will obtain the past performance evaluation worksheet from the person specified below and will have (3) references fax the completed form to the USPTO at (703) 305-8294 by the proposal due date. -Responses shall also include a copy of the provision at 52.212-3 Offeror Representation and Certifications Commercial Items. A copy of these representations and certifications may be obtained by contacting the person specified below. -The award will include the clauses cited at FAR 52.212-4 Contract Terms and Conditions Commercial Items and 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items. -All orders are F.O.B. destination within the stated delivery times.
