- Description
- The General Services Administration intends to issue a contract to Premier Wireless, Inc., of Orange, CA on behalf of the United States Custom Service, Washington, D.C.. through notice no. SN-40 pursuant to the authority of FAR Parts 12 and 13.501(a) Sole Source Acquisitions. The following requirement will be procured: Queuing Measurement Vehicle Recognition System (QMVRS)to track queuing times for passenger vehicles entering into the United States and to enable Customs officers to target designated vehicles in an automated fashion as they enter this country by vehicle color, vehicle type, as well as make and model. QMVRS is an enhanced version of Queuing Measurement System (QMS) that Customs has tested and evaluated and shown to successfully measure passenger vehicle queue waiting times, number of vehicles and throughput at the land border crossing at Mariposa (Nogales). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2002-10. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 13.501. The Government has concluded that there is only one responsible source and no other supplies or services will satisfy agency requirements. Premier Wireless is the sole provider of QMS and has patent pending intellectual property rights for the product. No other solutions were found that meets the minimum requirements. The U.S. Customs application represents a unique application requiring a custom product. A justification for Other than Full and Open Competition has been prepared in support of this acquisition. The provision at FAR 52.212-1, Instructions to Offerors, applies to this acquisition to the extent consistent with a sole source acquisition. Premier Wireless shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer. The clause at FAR 52.212-4, Contract terms and Conditions-Commercial Items, applies to this acquisition. The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition. This notice is not a request for competitive proposals. All interested parties must submit a capability statement that sufficiently describes their qualifications, capabilities, and previous experience related to fulfilling a similar requirement via email to fred.hersom@gsa.gov by 4:00 p.m., PST, January 10, 2003. A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
