- Description
- This is a sole source, combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as well as supplemental information provided herein. This non-competitive action will be processed in accordance with FAR 6.301-1 (Only one responsible source and no other supplies or services will satisfy agency requirements). The Patent and Trademark Office plans to issue a modification to Contract 50-PAPT-0-00085 to extend engineering consulting services with Open Text Inc., Bannockburn, IL for an additional thirty-six months at no increase to the ceiling amount of the contract. Open Text procured the proprietary rights to BRS software from Dataware, Inc. BRS software is a critical tool utilized in daily operations at the U. S. Patent and Trademark Office. The technical services are required in order to support BRS products utilized at the USPTO as well as to allow for the continuation and completion of the BRS Middle Tier Project for distributed architecture that has begun and is planned for completion of the next twenty-four to thirty-six months. As a result of the proprietary ownership of the BRS software, the services to be procured can only be performed by Open Text. The contract modification will be issued to establish an extension to the period of performance with no change to the existing ceiling price or fixed labor rates of this IDIQ Contract. This announcement constitutes the RFP and is the only solicitation that will be issued. A sole source proposal is being requested pursuant to this announcement. This solicitation incorporates all of the applicable provisions and clauses in effect through FAC 01-20 as if stated in full text, as well as the terms and conditions of FAR 52.212-1, 52.212-2; 52.212-3, 52.212-4; 52-216-18, 52.216-22, and 52.217-5. A proposal shall be delivered to the Patent and Trademark Office, Office of Procurement, 2011 Crystal Drive, CPK 1, Suite 810, Arlington, VA 22202, Attention: Ms. Joan Hanicak, no later than 2:00 PM (EST), March 08, 2004.
