Description
This is a combined synopsis/solicitation for the commercial items identified below, prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation, offers are being requested and a written solicitation will not be issued. This solicitation number: 4011265150-00023, is issued as a Request for Quotation (RFQ), and incorporates provisions and clauses that are in effect through Federal Acquisition Circular 2001-22(B). The U.S. Department of Agriculture in Beltsville, Maryland intends to procure the following two lined items as a sole source procurement under the authority of 41 U.S.C. 253 (1) where there is a reasonable basis to conclude that the U.S. Department of Agriculture's needs can be satisfied by one responsible source and no other instrument will satisfy U.S. Department of Agriculture's requirement. U.S. Department of Agriculture intends to procure the following instrument: (LINED ITEM 1): "Portable Fourier Transform ("FTIR") Mid-Infrared Spectrometer", Part Number: 0400-0000, Manufactured by "Surface Optics Corporation", - who are located at 11555 Rancho Bernardo Road in San Diego, California ? and they can be reached at phone number 858-675-7404. The above instrument shall be used to compliment existing laboratory instruments by allowing the scanning in the mid-infrared of samples on site without the need to necessarily remove the sample from it's environment ("In-Situ"). The above instrument shall also be able to compliment the existing instruments available from the "Remote Sensing and Hydrology Laboratory" at U.S. Department of Agriculture ? which can perform the same function for the near-infrared spectral range. The beam of the above instrument comes out from the front and any sample can be placed in front of it, which is what U.S. Department of Agriculture's minimum requirements are, and most ("FTIR") instruments that are portable - require the sample to be placed in a specific cell for scanning, and this is what U.S. Department of Agriculture's existing laboratory instruments are; However: U.S. Department of Agriculture requires the above instrument "without this limitation" ? in order to perform "In-situ" work - to scan the ground as it is without the need to take a sample from the ground and place it in a sample holder. The above instrument shall allow for scanning large samples by moving the sample under the spectrometer, such as "large samples of manure" on a rotating platter. The following are the MINIMUM REQUIREMENTS for the above instrument: Shall be capable of scanning the mid-infrared from 4000 to 400 wave-numbers at a resolution of 4 wave-numbers or better (lower values are better); Shall be a "Fourier Transform Spectrometer" - required to produce data complimentary to that produced by existing U.S. Department of Agriculture laboratory ("FTIR") instrumentation presently owned by U.S. Department of Agriculture; Shall be capable of scanning samples in diffuse reflectance mode with no limitation on the size of sample which can be scanned: e.g. ?The instrument shall be able to be positioned in such a way that any surface can be scanned in place by either moving the instrument over the sample or moving the sample under the instrument beam, e.g. ? no specific sample holder shall be required or limitation in getting a sample under the spectral beam; The instrument shall be capable oin any position, e.g. instrument can be placed upside down, sideways, in order to scan a sample surface; Instrument shall be capable of operating in a "portable" mode under battery power. (LINED ITEM 2): Diffuse Reflectance Head, Part Number: 0400-0013. (LINED ITEM 3): Part Number: 0400-5005, "Software" that shall operate the SOC 400 reflectometer. (LINED ITEM 4) Installation and Training for the above instrument. Delivery shall be F.O.B. Destination for the above requirement to Beltsville, Maryland 20705. Delivery is required 90 days after receipt of award. This solicitation incorporates the following FAR clauses, provisions and addendums: 52.212-1, Instructions to Offerors-Commercial Items; 52.212-2, Evaluation-Commercial Items; 52.212-3, Offeror Representations and Certifications-Commercial Items; 52.212-4, Contract Terms and Conditions-Commercial Items; 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items. In Paragraph(B) of 52.212-5, the following apply: 52.203-6, 52.222-21, 52.222-26, 52.222-35, 52.222-36,52.222-37, 52.225-3, 52.225-13, 52.232-34, and 52.222-70. COMPLIANCE WITH VETERANS EMPLOYMENT REPORTING REQUIREMENTS (JAN. 1999)(DEVIATION)(USDA). (a) The offeror represents that, if it is subject to the reporting requirements of 38 U.S.C. 4212 (d) (i.e., the VETS-100 report required by FAR Clause 52.222-37, Employment Reports on Disabled Veterans and Veterans of the Vietnam ERA), it has [ ] , has not [ ]. submitted the most recent report required by 38 U.S.C. 4212 (d). (b) An offeror who checks ("has not") may not be awarded a contract until the required report is filed. CONTRACT PAYMENT (MANDATORY INFORMATION FOR ELECTRONIC FUNDS TRANSFER) Electronic Funds Transfer Compliance with 31 CFR 208. To Facilitate EFT for Contract payments, FAR clauses 52.232-34 and 52.232-35 (31 CFR Part 208) requires the submission of information by the Contractor to the payment office. Upon Award, the Contractor shall contact the Miscellaneous Payments Section at the National Finance Center (NFC) at phone number: 1-800-421-0323 or at the WEB-SITE: WWW.NFC.USDA.GOV, to initiate the enrollment process of the Vendor Express Payment, which will result in a number being assigned to the contractor for payment under Electronic Funds Transfer (EFT). All offerors must include copies of 52.212-3 (Representations and Certifications) and 52.222-70 (Compliance with Veterans Employment Reporting Requirements). Faxed Quotations are acceptable to the attention of "John Wilkinson" at fax number 1-301-504-8696 on or before June 1, 2004 at 4:30 p.m. (E.S.T.). All responses will be evaluated in order to determine the ability to meet the above stated capabilities. Responses shall include technical specifications, literature, brochures, and other such information corresponding to each minimum requirement for each item, which demonstrates the capabilities of the offerors equipment. Offerors shall identify where the offered item meets or does not meet each of the Government's functional and performance minimum specifications listed herein. The Government shall award a contract resulting from this soliciatation to the responsive/responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government. The anticipated award date is June 2, 2004. All responsible sources may submit a quotation, which shall be considered by U.S. Department of Agriculture.
