- The purpose of this amendment is to change the set-aside code, the date for receipt of proposals, and to answer a question from a potential offeror. Following the statement - It is anticipated that three awards will be made as a result of this solic itation delete the following: One award will be made via a service-disabled veteran-owned small business set-aside. One award will be made via a small business set-aside and the other award will be made through full and open competition. Following the s tatement - It is anticipated that three awards will be made as a result of this solicitation insert the following: Of the three awards, at least one will go to service-disabled veteran-owned small business. The date for receipt of proposals is changed fr om 23 August 2004 to 31 August 2004. Question: With respect to the subject solicitation, we request clarification of the response to previous questions regarding the 51% rule. Several previous questions were answered to indicate that 51% of the work mus t be achieved by the PRIME CONTRACTOR. Please clarify. The ruling which authorizes SDVOSB set-asides is 46 CFR parts 2,3,6 et al. Germane to this issue is section 53-219-27(c)(1) which states: (1) Services (except construction), at least 50 percent of the cost of personnel for contract performance will be spent for employees of the concern or employees of other service-disabled veteran-owned small business concerns. If this is the governing rule, then more than 50% of the work must be done by Service D isabled Veteran Owned Compan(IES), not simply the singular SDVOSB as the answer implies. Answer: The contractor is correct. At least 50% of the cost of personnel for contract performance will be spent for employees of the concern or employees of other S DVOSB concerns under a non-construction service contract. The offeror shall acknowledge all amendments in his proposal.
