- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation and a separate written solicitation will not be issued. This solicitation number is NIH-NIDDK-04-281, and is issued as a Request for Quotation (RFQ). The solicitation/contract will include all applicable provisions and clauses in effect through Federal Acquisition Circular 2001-23. The North American Industry Classification (NAICS) Code is 339111 and the business size standard is 500 Employees. This acquisition is being conducted using Simplified Acquisition Procedures in accordance with FAR Part 13. The National Institutes of Health (NIH), National Institute of Diabetes and Digestive and Kidney Diseases (NIDDK), has a requirement for a ProteinChip? System Series 4000, Personal Edition fromCiphergen Biosystems, Inc., 6611 Dumbarton Circle, Fremont, CA 94555. The ProteinChip? System Series 4000, Personal Edition also includes: One ProteinChip Reader (Model Series 4000, Personal), including computer workstation with Microsoft Windows? 2000 and Ciphergen Software pre-loaded. CiphergenExpress? Personal Edition, a relational database software system. ProteinChip Starter Kit with cassette compatible Bioprocessor. Technology Transfer and Training: Transfer of technology to client and instrument familiarization at the client?s facility. ProteinChip University Basic Course: One tuition to the ProteinChip Univeristy Basic Course held at a Ciphergen training center. Course must be taken within six months of system purchase. Label License: Surface Enhanced Laser Desorption/Ionization (?SELDI?) is a patented process. To use the SELDI process an end-user must obtain a two-part license from Ciphergen. The purchase price of a Ciphergen ProteinChip System, which includes a SELDI ProteinChip Reader, includes the up-front component of the license. The purchase price of ProteinChip Arrays includes the running-royalty component of the license. The license is for internal research and development purposes only and prohibits the use of SELDI to perform commercial services of any kind. Appropriate notices appear on each product. The license is not transferable without Ciphergen?s express prior written approval. ProteinChip Arrays: 120 chromatographic profiling ProteinChip Arrays. One-year Warranty. The ProteinChip? System Series 4000, Personal Edition shall meet the following specifications: Direct qualitative and quantitative analysis of proteins and peptides from crude (bioreactor), semi-pure or pure samples without prior, off-line purification. Simplified chromatography purification development on a chip-based platform. Preparation of affinity arrays for user specific mass-based assay development. Sample analysis by PCS4000 can be completed in as little as 5-10 minutes vs. ~30-60 minutes using the alternative method. The PCS4000 can analyze 180-360 samples in an 8 hour day, unattended. The alternative approach can analyze ~10-20 samples in the same time period and requires full-time attendance. The PCS4000 enables quantitative analysis of proteins and the development of assays with low degrees of variability. Neither of these outputs is possible by the alternative approach. The PCS4000 can be used to develop direct mass-based assays to facilitate, among other things, all aspects of protein production, including fermentation/cell culture optimization, purification development, and product analysis. The PCS4000 provides a wide dynamic mass range. The PCS4000 provides a lower cost of acquisition and operation. This notice of intent is not a request for competitive quotations however, all responses received, within 15 days from the date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete this proposed acquisition is based upon responses to this notice and is solely for the purpose of determining whether to conduct a competitive acquisition. The offeror must include a completed copy of the provision of FAR Clause 52.212-3, Offeror Representations and Certifications ? Commercial Items with its offer. The provisions of FAR Clause 52.212-4, Contract Terms and Conditions ? Commercial Items, applies to this acquisition. The addenda to the clause reads as follows: The offeror must include in their quotation, the unit price, the list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. The FAR Clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders ? Commercial Items ? Deviation for Simplified Acquisitions, applies to this acquisition. Interested vendors capable of furnishing the government with the item specified in this synopsis should submit their quotation to the below address. Quotations will be due fifteen (15) calendar days from the publication date of this synopsis or August 24, 2004. The quotation must reference ?Solicitation number? NIH-NIDDK-04-281.
