Description
This synopsis is being posted to both the Federal Business Opportunities (FBO) page located at http://www.eps.gov and the Navy Electronic Commerce on Line(NECO) site located at http://www.neco.navy.mil. While it is understood that FBO is the single point of entry for posting of synopsis and solicitations to the internet, NECO is the alternative in case FBO is unavailable. Please feel free to use either site to access information posted by the Navy Sea Systems Command. The purpose of this modification to presolicitation notice N00024-04-R-6121 is to provide answers to questions 1 and 2 regarding the Torpedo Advanced Processor Build (APB) Broad Agency Announcement (BAA). These answers result in no change to the BAA as posted on 13 July 2004. The due date for proposals remains unchanged. The questions and answers are as follows: 1. QUESTION: ?Please elaborate on the Intellectual Property requirements for the Torpedo APB? Does the Navy want license for use or ownership of the torpedo processing software?" ANSWER: ?The Government desires at least Government Purpose Rights (GPR), as defined by DFARS 252.227-7014(a)(11) entitled RIGHTS IN NONCOMMERCIAL COMPUTER SOFTWARE AND NONCOMMERCIAL COMPUTER SOFTWARE DOCUMENTATION (JUN 1995), in all torpedo processing software deliverables. The contractor will retain "ownership" (e.g., title) to all computer software deliverables. The Government intends to require the contractor to deliver all object code, source code, software specification and standards and developer tool kits necessary to enable the Government to modify and upgrade the torpedo processing software, including integrating the software into other torpedo or naval weapons systems." 2. QUESTION: ?Torpedo BAA solicitation says that ?the Navy intends to award up to (3) preliminary Cost Plus Fixed Fee (CPFF) studies??. We are inquiring as to whether a bid submitted on a Time and Material (T&M) basis, rather than on a cost-plus-fixed-fee (CPFF) basis, would be acceptable to the government for this solicitation?" ANSWER: ?Time and Material (T&M) contracts are the least preferred contract type. Per FAR 16.601(b), a time-and-materials contract may be used only when it is not possible at the time of placing the contract to estimate accurately the extent or duration of the work or to anticipate costs with any reasonable degree of confidence. Justification that no other contract type is suitable for the acquisition is required in order to use T&M type contracts. Adequate justification does not exist to procure on a T&M basis. For the Torpedo Advanced Processor Build (APB) Program, the Cost-Plus-Fixed-Fee (CPFF) contract type has been identified as the most appropriate. If the offeror chooses to propose on an other than CPFF basis, there is the risk that the proposal will not be among the most highly rated proposals and therefore not accepted for negotiation or accepted pending the availability of funds. Additionally, any submission on an other than CPFF basis may be considered non-r! esponsive and not considered for award.?
