Description

The Amendment adds the following paragraphs to the Statement of Work, Attachment 1: D.4.1 Notwithstanding any term to the contrary, the contractor is responsible for all costs for maintenance and repair of all Items in SECTION B (SUPPLIES OR SERVICES AND PRICE/COSTS (pages 7 thru 25) (except for item 9 which has been deleted) unless the needed repair has been caused though the fault or negligence of the Government. The determination as to whether or not the Government is responsible for the cost of the repair will be decided by the Contracting Officer, based on available facts and evidence. Failure of the parties to this contract to reach agreement on any request for equitable adjustment, claim, appeal or action arising under or relating to this contract shall be a dispute to be resolved in accordance with the clause at FAR 52.233-1, Disputes, which has been incorporated by reference. The Contractor shall proceed diligently with performance of this contract, pending final resolution of any dispute arising under the contract. Amendment 3 adds the following paragraphs to the Statement of Work: D.4.2 In the event a service call determined to be the responsibility of the Government, is required, the Contractor, prior to commencing work shall obtain written authorization and a separate purchase order number from the Contracting Officer.
