Description
In accordance with 15 U.S.C. 631 and 10 U.S.C. 2304(c)(5), the United States Special Operations Command (USSOCOM) intends to negotiate on a sole source basis with Laguna Industries of Laguna, NM, as a certified HUBZone contractor for enhancements to the Voice Response Translator (VRT) provided under contract USZA22-03-C-0049. On 18 April 2003, USSOCOM issued a Broad Agency Announcement (BAA) for Biomedical Research. Under this BAA, the Laguna VRT was proposed for medical use. The VRT was evaluated, and recommendations for USSOCOM enhancements were made. The purpose of this sole source HUBZone requirement is to incorporate these enhancements into the VRT. It is anticipated that Laguna will incorporate these enhancements into the VRT and provide five laboratory units and fifty test units for field-testing. The reason justifying the lack of competition is twofold. First, 15 U.S.C. 631 and 10 U.S.C. 2304(c)(5) specifically permit a Government agency, such as the USSOCOM, to enter into a contract with a certified HUBZone contractor as long as the conditions in FAR 19.1306(a) are met. The USSOCOM has determined that all the conditions set forth in FAR 19.1306(a) exist. Second, USSOCOM does not own the data rights or have any schematic drawings to the VRT provided under contract USZA22-03-C-0049. Therefore, even if another certified HUBZone contractor exists, there is no technical data for them to perform the required enhancements. Note 22 applies.
