- The Southwest Division, Naval Facilities Engineering Command intends to award a contract, on a sole source basis, in accordance with Simplified Acquisition Procedures the aggregate amount of which will not exceed $100,000.00 to Kiva Biological Consulting, Inyokern, California. The purpose of this acquisition is to obtain technical services to survey line-distance transects for the desert tortoise at the Chocolate Mountain Aerial Gunnery Range (CMAGR), California in compliance with the U.S. Fish and Wildlife Service (USFWS) biological opinion for the range and monitor a population of desert tortoises (Gopherus agassizii) at the Marine Corps Air Ground Task Force training Command, Twentynine Palms, California. The statutory authority permitting other than full and open competition is 10 U.S.C.2304(c)(1), as implemented by Federal Acquisition Regulation, Part 6.302-1, only one responsible source and no other supplies or services will satisfy the agency?s requirements. Successful completion of this contract is dependent upon expert knowledge of USFWS long-term desert tortoise monitoring, survey, and handling protocols in the Mojave Desert, obtaining USFWS approval to participate in the Line-Distance Training Workshop being held March 2005 in Jean, Nevada that is required by the annual range-wide desert tortoise line-distance survey program, and USFWS authorizations/permits prior to contract award. It is the Government?s position that award to any other source would result in unacceptable delay in fulfilling the agency?s requirement. Therefore, no other offers will be accepted. The contract duration is approximately 300 days with an option to extend the contract for one year.
