Description
The Army Contracting Agency, White Sands Missile Range, intends to conduct a full and open competition for the operation and maintenance of foreign ground weapon systems and foreign aviation equipment in support of the Threat Systems Management Offic e (TSMO), Huntsville, AL. The NAICS Code for the full and open competition will be 541330 with a size standard of $23M. The services involve operation and maintenance of foreign ground weapon systems, operation and maintenance of foreign aviation equipment , engineering and technical support as related to corrective maintenance, training support, test support, and marketing. This will include permitting competition from companies that engage in the design, development or production of aerospace or other sys tems or major subsystems of a type normally developed, tested or evaluated utilizing TSMO assets/equipment. While Organizational Conflict of Interest (OCI) issues are a significant consideration, they may be mitigated with an acceptable mitigation plan. In order for us to resolve any OCI issues as early as possible in the acquisition cycle, we have decided to initiate a process following the principles of FAR 15.202 Advisory Multi-Step Process and pre-qualify competitors. Since ensuring the continued trust of our customers is of paramount importance, we must understand the safeguards and mitigation strategies necessary to ensure any perceived or actual organizational conflict of interest is avoided, neutralized, or mitigated. We encourage every company that expects to submit an offer as a prime contractor or as a member of a contractor teaming arrangement to review the OCI discussion found at Federal Acquisition Regulation (FAR) Subpart 9.5 and 10 USC 2399 and determine the potential for an OCI. If you dete rmine that there is the potential for an OCI, you should next analyze the situation and decide whether the potential OCI can be mitigated through a particular course of action as stipulated in a mitigation plan. If so, such a mitigation plan should be dra fted and submitted for evaluation. If you decide that no real or perceived conflict exists, please tell us the basis for your decision and we will tell you whether we agree. We intend to evaluate your mitigation plan to assess its risk and content. A tho ughtful, comprehensive plan addressing in detail the elements listed on our webpage at http://www.wsmr.army.mil/docpage/pages/sol_stat.htm is our expectation. Upon evaluation of your submission, we will advise you (solely from an OCI perspective) whether w e believe your company is a viable competitor. We will publish a list of viable competitors and they will be invited to participate in this acquisition. The Government will treat all submissions as proprietary under 18 U.S.C. §1905 and protect the propose d information accordingly. Your submission must be received by 2:00 PM, MST on 23 May 2005.
