Description
USAID/Ukraine intends to solicit, on an other than full and open competition basis, professional and technical services to support an ongoing USAID project of Commercial Law Reform Program (CLRP) in Ukraine. Services are required from October 2005 through April of 2006. Services are required in the following functional areas: provide further development of commercial legislation and concomitant training of judges, state executor officers and the legal community; establishment of a registry of all economic court decisions; and creation of an automated administrative and case management system for the economic courts. The procurement is being processed through other than full and open competition pursuant to the statutory authority of 41 u.s.c. 253(c)(1), as implemented by FAR 6.303-2. The government intends to solicit and negotiate with Emerging Markets Group, Ltd., Washington, DC for this requirement. Emerging Markets Group, Ltd. is currently providing services for the CLR project under contract 121-C-00-00-00823-00. Emerging Markets Group is the only firm with the personnel and the requisite expertise in place that can provide broad-based stakeholder inclusion in the development of commercial law and the dissemination of information about these laws in time for the Ukraine parliamentary elections. There is no other institution that can provide the required expertise in the sector of commercial law and permits in Ukraine. Interested organizations may identify their interest and capability to respond to this requirement by the specified response date. This notice of intent is not a request for proposals. However, the Government will consider information received by the specified response date. Information received as a result of this notice of intent will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this proposed procurement action based upon responses received is solely within the discretion of the Government. The Government will not pay for any expenses incurred on preparation and submission of information submitted in response to this notice.
