Description
The purpose of this amendment is to answer questions received from potential offerors. Question 1. Is this solicitation open to foreign (Australian) registered companies or to U.S. registered but foreign owned companies? Does the fact that the US & Australia signed a Free Trade Agreement in early 2005 have any bearing on the above situation? Answer 1. DFARS 252.225-7021 TRADE AGREEMENTS states that Australia is a ?Designated Country? and a ?Free Trade Agreement Country?. The clause further states that offers for ?Designated Country end products? be treated as though they were U.S.-made. ?Designated Country end products? include ?Free Trade Agreement end products? which are those grown, produced or manufactured in a ?Free Trade Agreement Country? or have been substantially transformed in a ?Free Trade Agreement Country?. See the DFAR cite for the exact language. Question 2. Is NRL ?expecting? this SWIR imager to built from COTS items much like the PHILLS II sensor? Your six month delivery schedule would either suggest that or that there was already a vendor with the right item essentially ?ex stock?? Answer 2. NRL does not have a preferred method for responding to the solicitation. However, our understanding of the state of the art in this field suggests that integration of COTS components, or alternatively the manufacture of a ?stock? item, represents viable ways to respond to the solicitation.
