- 1. Project: Initial Task Order. The Tamiami Trail portion of the Modified Water Deliveries to Everglades National Park Project involves the acquisition of land for privately-owned tracts south of Tamiami Trail (Highway 41) of Miami-Dade County, Flo rida as part of the overall Central and South Florida Project. NOTE: Future task orders may be issued for these services in FL, Puerto Rico or the Virgin Islands during the course of the contract. 2. Purpose: In order to comply with Department of Justice standards and regulations, Real Estate Division must acquire title insurance for each tract of land. A requisite of obtaining title insurance is to pay a premium for such insurance. The title in surance premium rates are regulated by the State of Florida (FL. Admin. Code Ann., Chapter 69, 69O-186.003, see attached). 3. Statement of Work: An initial title commitment is obtained from the title company in order to determine ownership and any defects on the title to the land. Once title to the land has been cleared of all unacceptable defects, the title company issues a title endorsement removing encumbrances from the title commitment and updates the status of the title to determine if any other defects have occurred since the date of the title commitment. If no new defects appear on the title, the property is acquired by Real Estate Division. Thereafter, a final title policy must be issued to the U.S. government covering the government from causes of actions relating to items covered in the final title policy. A title insurance premium, promulgated by the State of Fl orida, is paid in addition to the final title policy amount. Should any item that appeared on the title commitment be cleared after the final title policy is issued, the title company will issue an endorsement to the final title policy. 4. Deliverables: The title company will issue legal descriptions for the tracts specified by the Corps in a format required by the Corps, initial title commitments (preliminary binders with exceptions); continuations of title (updates of title); final ti tle policies; Severable Use Right (SUR) information; Oil, Gas and Minerals ownership information; and any other business products that may be obtained from a title company, including but not limited to escrow and closing services. The selected title compa ny should use a Department of Justice approved title underwriter for all title products stated above. All items will be delivered within 45 days of the notice to proceed. It is anticipated that the selected title company will produce all title commitment s within two weeks. Payment made on acceptance by government. Furthermore, the U.S. Army Corps of Engineers attorney(s) will conduct the real estate closings; however, the Corps may request that the title company perform all curative work necessary to c lear title to the land and prepare a case for closing within 30 days of the Corps request. Should the title companys efforts to clear title be unsuccessful or appear to take a significant amount of time beyond the 30 days, the title company will notify the Corps so that condemnation procedures can be initiated in order to clear title to the property. Final title policies should be produced within 45 days of closing. The government intends to award a fixed price indefinite quantity contract for these services for one year with four one-year options. The total ceiling price of the contract, with options, will be $550,000. This acquisition is 100% set-aside for small bu siness under NAICS 541191, the size standard of which is $6.5 Million.
