- NASA Headquarters, Office of Diversity and Equal Opportunity has a mandated requirement for independent external compliance reviews in the Civil Rights arena, regarding gender equity in science, technology, engineering and mathematics (STEM) programs, required under Title IX of the Education Amendments of 1972 and the current NASA authorization law (Pub. L. No. 109-155). The reviews consist in part of providing expertise and guidance to NASA with regards to Title IX and other regulatory compliance issues; reviewing and analyzing material provided by a selected university; identifying and interviewing key individuals and groups on Title IX compliance; analyzing and synthesizing data gathered and to provide a report of promising practices, concerns and findings, with suggestions for voluntary compliance agreements and monitoring plans, if necessary. Per FAR PART 6.302-1, NASA/HQ intends to purchase the services from JN Kennedy Group, LLP, which is the only source available that can perform these services within the scheduled timeframe. They possess a unique combination of expertise on issues related to STEM that qualifies them to assist NASA in conducting Title IX compliance reviews. The Government does not intend to acquire a commercial item using FAR Part 12. See Note 26. Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact not later than 3:30 p.m. local time on August 17, 2006. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice. All responsible sources may submit an offer which shall be considered by the agency. An Ombudsman has been appointed.
