- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a separate written solicitation will not be issued. Solicitation Number DG133W07RP-Filter. This solicitation is issued as a request for proposal (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-13. This is a small business set-aside, NAICS code 334419 small business size standard is less then 500 employees. CLIN 0001, firm fixed price, Radio Frequency Filter, unit of issue/ each, QTY 24, delivery 120 days after award. CLIN 0002 OPTION, firm fixed unit price, Radio Frequency Filter, unit of issue/ each, Indefinite Quantity, Minimum QTY 24, Maximum QTY 476, option may be exercised within 180 days after award. The ordering period for CLIN 0002 is 12 months starting from the exercise of option. See attached specification for item description. Delivery and acceptance and FOB destination point: NOAA NWS, ATTN: Dom Bosco, BLDG SSMC2, Room 3212, 1325 EAST WEST HWY, SILVER SPRING MD 20910-3283. Provision at 52.212-1, Instructions to Offerors?Commercial, applies to this acquisition. There is one addendum to FAR 52.212-1; specifically, this addendum is as follows: ?With respect to Paragraph (b)(4) of FAR 52.212-1, the technical description to be submitted as part of the proposal shall include a certificate of compliance and filter test data from a calibrated spectrum analyzer to demonstrate compliance of the filter with Specification Section 3.2 General Requirements and Section 3.2.2.4 Radio Frequency Characteristics.? FAR Provision 52.212-2, Evaluation?Commercial Items, does not apply. Proposals will be evaluated with respect to technical acceptability and price. Award will be made to the lowest-priced technically acceptable offer from a responsible offeror. Price will be calculated as the total price proposed for CLIN 0001 plus the product of the unit price proposed for CLIN 0002 multiplied by the Maximum Quantity for CLIN 0002. Technical acceptability will be determined by the Government based upon (1) the technical materials submitted by the offeror, as called for by the above addendum to FAR 52.212-1, and (2) the offeror?s past performance [offerors are advised that Paragraph (b)(10) of FAR 52.212-1 calls for the offeror to submit past performance information as part of its proposal]. Offerors to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications?Commercial Items, with its offer. Clause at 52.212-4, Contract Terms and Conditions?Commercial Items, applies to this acquisition. There are no addenda to FAR 52.212-4. Clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders?Commercial Items, applies to this acquisition. The following additional FAR clauses cited in FAR 52.212-5 (b) are applicable to this acquisition: 1, 5(i), 7, 9, 14, 15, 16, 17, 18, 19, 20, 21, 23, 26, 31. The following additional contract terms and conditions apply: (1) FAR Clause 52.217-7, Option for Increased Quantity- Separately Priced Line Item; the option must be exercised within 180 days after award (2) FAR Clause 52.216-18, Ordering, applies to CLIN 0002 only; the ordering period is from the date of option exercise through 12 months thereafter (3) FAR Clause 52.216-22, Indefinite Quantity, applies to CLIN 0002 only; the Contractor shall not be required to make any deliveries under the contract after one month after the end of the ordering period (4) The substance of FAR Clause 52.216-19, Order Limitations, applies to CLIN 0002 in that should the Government exercise its option for CLIN 0002, the Government shall order at least 24 units under CLIN 0002, but no more than 476 units. Provided that the Government stays within these boundaries in placing orders for CLIN 0002, the Contractor is obliged to honor all orders placed by the Government under CLIN 0002. The Defense Priorities and Allocations System (DPAS) is not applicable. Numbered Note 1 applies.
