- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. The announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Request for Quotation (RFQ) #0258115 is assigned and shall be referenced on any quotations. All incorporated provisions and clauses are those in effect through Federal Acquisition Circular 05-13. This solicitation is being conducted under the Simplified Acquisition Procedures (SAP). The North American Industry Classification System (NAICS) code for this acquisition is 511210. The size standard for the NAICS code is $18 million annually. The Federal Bureau of Investigation (FBI) intends to solicit and negotiate on a sole source basis with Pen-Link, Inc. for operational maintenance and purchase of additional software for Pen-Link software Pen-Link version 8.0 Telephone Analysis Software Application. It shall include operational maintenance and technical support for the Pen-Link 8.0 Telephone Analysis Application and along with version upgrades, and patches. The contract will be a Firm Fixed Price Contract for one (1) base year plus four (4) one year options. This is a small business set aside. The proposed contract action is for software maintenance and technical support for which the government intends to solicit and negotiate with only one source under the authority of FAR 6.302 and will result in a Firm Fixed Price contract for one base year plus four (4) one year option periods beginning upon the date of award. FOB-Destination. Interested parties may identify their interest and capability and respond to this requirement and submit a quote in order to be considered. FOB-Destination. This is not a request for competitive quotes. However, all compliant quotes received by 4:00 p.m. on December 8, 2006, will be considered by the Government. A determination by the Government not to compete this proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received from other than the requested party will be considered solely for the purpose of determining whether to conduct a competitive procurement. The following clauses and provisions are incorporated by reference and apply to the acquisition: FAR 52.212-1 Instructions to Offerors? Commercial Items (Jan 2005); Offerors may download the RFQ by accessing the FedBizopps website www.fedbizopps.gov; FAR 52.212.4 ? Contract Terms and Conditions ? Commercial Items (Oct 2003); FAR 52.212-5 Contract Terms and Conditions Required to Implement Statues or Executive Orders ? Commercial Items (Jan 2005), Facsimile Proposals (Oct 1997). Each offeror shall include a completed copy of the FAR provision 52.212-3 Offeror Representations and Certifications-Commercial Items (JAN 2005). All quotes shall be clearly marked with RFQ Number 0258115 and shall be submitted to Contract Specialist, Robert J McMahon, at the address above no later that 4:00 p.m. on December 8, 2006, and be clearly marked with RFQ number 0258115. No hand carried quotes will be accepted. Interested parties are hereby notified that due to security issues faxed offers will be accepted. Faxed quotations are encouraged and shall be submitted to (202) 324-3104. Quotations may also be submitted via email to Robert.mcmahon@IC.fbi.gov. If your response is not received by the designated time/date and at the location specified in the announcement, it will not be considered. Award to be made within one (1) week after closing. Telephone requests will not be honored.
