Description

U.S. Army Space and Missile Defense Command intends to issue a contract to CommVault Systems Inc, Oceanport, NJ through solicitation no. W91260-07-T-0003 pursuant to the authority of FAR Parts 6.3, 12 and 13.501(a) Sole Source Acquisitions. CommVault Systems Inc will be providing one (1) year Galaxy Software Premier Maintenance/Support renewal for the following licensed software products: AFP-ADCL (1), CommServe StorageMgr (1), Content Indexing Connection License (1), Content Indexing Server License ( 1), DA-DataMigrator File System (3), DA-Solaris (2), DA-Windows Server (2), DDO for unlimited TB (1), Library Management Software (1), SAN MediaAgent (2), Shared Library Management Software (1), and Shared Storage with iDDs (4). CommVault Systems Inc will be providing the aforementioned software maintenance/support renewal for SMDC/ARSTRAT, G2 MASINT AGI Branch, Peterson AFB, Colorado. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulations document (FAR) subpart 12.6, as supplemented with additional information included in this notice. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-15. The pro posed contract action is for one (1) year Galaxy Software Premier Maintenance/Support renewal for CommVault licensed software products for which the Government intends to solicit and negotiate with only one source under the authority of FAR 13.501. There i s only one responsible source and no other services will satisfy agency requirements. CommVault Systems Inc is the manufacturer of the licensed software products that the software maintenance/support renewal is required for and the required software mainte nance/support is exclusively available from CommVault Systems Inc only. A justification for Other than Full and Open Competition has been prepared in support of this acquisition. The provision at FAR 52.212-1, Instructions to Offerors, applies to this acqu isition to the extent consistent with a sole source acquisition. Offerors shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer. The clause at FAR 52.212-4, Contract ter ms and Conditions-Commercial Items, applies to this acquisition. The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition. This is not a solicitation nor is i t a formal request for proposal.
