- This is an advance notice announcing the intent of the Seattle District US Army Corps of Engineers to award a sole-source firm fixed price indefinite delivery, indefinite quantity task order contract with a base and two option years to the Colville F ederated Tribes for the provision of all services, labor, materials, and equipment to perform contract task orders for cultural resources management activities, including the frequent visitation of cultural resource sites (including traditional cultural pr operties) and ancestral cemeteries; evaluation and protection of such sites; and routine interaction with local governments and the public. Performance of all work will be on the Colville Tribal Lands/Ceded Land Areas. The action is authorized by 10 U.S.C. 2304 (c)(1), or 41 U.S.C. 253 (c)(1), FAR 6.302-1 (iii) entitled only one responsible source and no other suppliers or services will satisfy agency requirements. The resultant contract with the Colville Confederated Tribes (CCT) will require technical expertise, labor and materials unique to the CCT for Cultural Resource Management tasks at the Chief Joseph Dam project. This action is in conformance with the National Historic Preservation Act of 1966, as amended; the Reservoir Salvage Act of 1960, as amended; the Native American Graves Protection and Repatriation Act of 1990 (NAGPRA--P.L. 101-601,and 43 CFR Part 10, Department of Interior NAGPRA Regulations); the Secretary of the Interiors Standards and Guide lines for Archaeological Documentation, (Federal Register Volume 48, Number 190, pp. 44734-44737, September 29, 1983); ER1130-2-540; Recent Executive Orders; Supplement 3 to Design Memorandum 38, Cultural Resources, Operations and Maintenance Cultura l Resources Management Plan; and Annual Action Plans prepared under provisions for implementing the Direct Funding Agreement. The Corps of Engineers has a special exclusive relationship with Indian tribes whose tribal lands or ceded lands are in project areas, particularly with respect to NHPA and NAGPRA. This project is entirely within the CCT ceded lands, and the north half of the project is within the Reservation of the CCT. The CCT is the sole representative for Native American tribes with NAGPRA jurisdiction at the site. Due to the projects geographic location and the exclusive arrangement, there is no other authorized or ganization capable of performing the required services. This action is in accordance with NAGPRA provisions at 43 CFR Part 10, Subpart B governing Agency action regarding Human Remains, funerary objects, sacred objects, or objects of cultural patrimony fr om Federal or Tribal Lands. All collected materials not subject to NAGPRA review are personal property under the ownership of the Government.
