- The NASA Facilities Engineering and Real Property Division proposes to enter into a contract with the National Institute of Building Sciences (NIBS), for software tools and services that are necessary to maintain specifications and facilities documents jointly in a secure environment with other participating Federal agencies. These tools and services are only available through NIBS. NIBS is an authoritative non-profit resource on matters of building regulations, science and technology in the United States having expertise in the technology. NIBS was established to provide for free and open discussion of technical issues and problems affecting building design, construction and management where there was once conflict and misunderstanding between government and the private sector building industries. The Institute brings together representatives of Federal, state and local government agencies, and representatives of the private sector and consumer interest for open, working sessions that seek consensus solutions to building problems of mutual concern. NIBS also has a Cooperative Research and Development Agreement (CRADA) with the U.S. Army for the purpose of establishing a license agreement to make accessible to private industry, Federal, state and local governments the Project Extranet (ProjNET) software suite developed by the U.S. Army. NASA has a requirement for software tools and services that are necessary to maintain specifications and facilities documents jointly in a secure environment with other participating Federal agencies. These tools and services are only available through NIBS. The tools include the Project Extranet (ProjNET) software suite; other inter-related products and services; and membership in NIBS. ProjNet is a suite of tools used to support various facility design and construction activities. These tools include the Design Review and Checking System (DRCHECKS), the Criteria Management System, the Criteria Change Request System, and the Construction Operations Building Information Exchange (COBIE). Other inter-related products and services include developing and maintaining the Whole Building Design Guide; facilitation of the buildingSMART Alliance, and performing specialized studies in which NASA requires the unbiased expertise of NIBS Councils and Committees. These products and services are presently acquired from NIBS via individual interagency funds transfers to the US Army Corps of Engineers and the General Services Administration or through purchase orders. A change in the Army's administrative procedures for managing ProjNET now requires NASA (and all other agencies) which use ProjNET to use NIBS as the means of access. The statutory authority for procuring this requirement by other than full and open competition is FAR 6.302-1, Only One Responsible Source and no Other Supplies or Services will Satisfy Agency Requirements. Citation: 10 U.S.C. 2304(c)(1). The National Institute of Building Sciences (NIBS) was authorized by the U.S. Congress in the Housing and Community Development Act of 1974, Public Law 93-383. The Government does not intend to acquire a commercial item using FAR Part 12. See Note 26. The Government anticipates awarding a five year, cost-no fee, indefinite delivery, indefinite quantity contract. Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact not later than 3:30 p.m. local time on August 10, 2007. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice. All responsible sources may submit an offer which shall be considered by the agency. An Ombudsman has been appointed.
