Description
(i) The USDA, Animal and Plant Health Inspection Service Beltsville, MD (APHIS) PPQ RMS intends to issue a Commercial Purchase Order for NEW LAB 250 SCIENTIFIC LABORATORY STEAM STERILZER 20"x20"x38" NAME BRAND OR EQUAL, INSTALLED. This requirement is being procured using Simplified Acquisition Procedures, utilizing FAR 13.003(b)(1) Set Aside for Small Business. The solicitation is issued as a Request for Quotation (RFQ). This announcement constitutes the only solicitation; quotations are being requested and a separate written request for quotation will not be issued. (ii) The solicitation number PR137386 issued as a request for quotation (RFQ). (iii) The provisions and clauses incorporated into this solicitation document are those in effect at the time of publication. Provisions and clauses incorporated by reference have the same force and effect as if they were given in full text. The full text of the Federal Acquisition Regulation (FAR) and Agriculture Federal Acquisition Regulations supplement (AGARs) can be accessed on the Internet at http:// www.arnet.gov/far and http://www.usda.gov/procurement/policy/agar. (iv) It is anticipated that a single award will be made. The associated NAICS code for this effort is 334513. (v) This requirement consists of (6) line items: Line Item #1 NEW STEAM STERILIZER; Line Item #2 One loading rack and two associated shelves for 20" x 20" x 38" chamber for single door only; Line Item #3 Contractor shall furnish all labor, materials, and equipment to disconnect all necessary utilities to existing sterilizer, remove and transport existing sterilizer to an appropriate location for pickup and disposal from the government premises. Removed equipment will become the vendor?s property; Line Item # 4 Contractor shall furnish all labor, materials, and equipment to uncrate, set-in-place, re-erect, and assemble new steam sterilizer; Line Item # 5 Contractor shall furnish all labor and equipment to dispose of existing sterilizer from federal property; Line item # 6 Freight and Delivery charges for new steam sterilizer, FOB Destination, USDA APHIS PPQ RMS Beltsville, MD 20705. All deliverables must be provided no later 45 DAYS after award. The Specifications for this requirement is provide as Attachment 1 - Specifications. (vi) Delivery and acceptance of deliverables will be FOB destination (vii) The provision at 52.211-6 Brand Name or Equal (8/99) - 52.212-1, Instructions to Offeror's - Commercial, applies to this solicitation. (viii) The provision at 52.212-2, Evaluation - Commercial Items, applies to this solicitation. The following text is added to paragraph (a) of the FAR 52.212-2: (i) technical capability of the item offered to meet the Government requirement (ii) past performance; and (iii) price. Technical and past performance, when combined, are equally important when compared to price. Offerors with no past performance will be rated neutral. A competitive firm-fixed price award will be made to the responsible firm with the best value quote trading off expected value against probable costs. The product at a minimum must meet or exceed the technical specifications. Technical acceptability is on a poor/good/excellent rating. Merits of offer will be rated based on compliance with Attachment 2. (ix) An offeror shall complete only paragraph (k) of this provision if the offeror has completed the annual representations and certifications electronically at http://orca.bpn.gov. If an offeror has not completed the annual representations and certifications electronically at the ORCA website, the offeror shall complete only paragraphs (b) through (j) of this provision. (x) The clause 52.212-4 Contract Terms and Conditions; 52.204-6 Data Universal Numbering System; 52.204-7 Central Contractor Registration. (xi) The clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items, applies to this acquisition: Contract Terms and Conditions Required in Implement Statutes or Executive Orders- Commercial Items (Oct 2004) (a) The Contractor shall comply with the following FAR clauses, which are incorporated referenced: (1) 52.203-6, Restrictions on Subcontractor Sales to the Government (Jul 1995), with Alternate I (Oct 1995) (41 U.S.C. 253g and 10 U.S.C. 2402). (1) 52.233-3, Protest After Award (Aug 1996) (31 U.S.C. 3553). The Contractor shall comply with the FAR clauses in this paragraph (b) that the Contracting Officer has indicated as being incorporated in this contract by reference to implement provisions of law or Executive orders applicable to acquisitions of commercial items: (8) (i) 52.225-3, Buy American Act Free Trade Agreements-Israeli Trade Act (Oct 2004) (41 U.S.C. 10a-10d, 19 U.S.C 3301 note, 19 U.S.C. 2112 note, Pub L. 108-77, 108-78. (xii) To be awarded this Purchase order, the offeror must be registered in the Central Contractor Registration (CCR). CCR information may be found at http://www.ccr.gov. The following clauses identified at paragraph b of the clause are considered checked and is applicable to this acquisition. 52.203-3 Gratuities (xiii) The Defense Priorities and Allocation System (DPAS) is not applicable to this acquisition. (xiv) Number notes not applicable (xv) Quotations are due September 24, 2007, 10:00 a.m. Central Time.
