- The U.S. Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), National Weather Service (NWS), National Logistics Support Center (NLSC), located in Kansas City, MO intends to establish a fixed price purchase order for fifteen (15) electronic enclosure assemblies, NSN: 5998-01-520-7208, ASN: S100-2MT6-3A2 on a sole source basis from C. C. Lynch & Associates, Inc, Pass Christian, MS based on the following: 1) The All Weather Precipitation Accumulation Gage (AWPAG) is an unattended sensor, operating continuously under the control of the Automated Surface Observing System (ASOS). The sensor measures precipitation by weighing total accumulation and compensates for evaporation and wind-induced vibration effects via an internal algorithm. While the technology for AWPAG is Commercial-Off-The-Shelf (COTS), the sensor was modified for ASOS implementation in 2003. It is clear that the Electronics Enclosure Assembly was designed as a full developmental effort to satisfy the needs of the Government and it appears that the Government has unlimited rights to the technical data used to physically integrate the AWPAG into the ASOS; 2) A complete escrow drawing package is available for all hardware components, however, the Government is not able to effectively segregate the proprietary data from publicly owned data without an engineering effort to prepare derivative works; 3) Without appropriate drawings and specifications for the AWPAG Electronics Enclosure Assembly, the unique design characteristics are unable to be duplicated on the open market; 4) Any unexpected variations in performance may damage the sensor and/or affect the operational output of precipitation data, potentially adversely impacting aviation and the climactic record; 5) Existing hardware repair parts for this system are now stocked by part number at the NLSC; 6) Design changes will result in considerable and unnecessary expense to the Government in logistics and maintenance; 7) Additional funding is not available for an engineering effort to prepare derivative works and the Government sees no reason to allocate funding for that additional task;
