Description
Statement of Work: Attorney The Overton Brooks VA Medical Center, Shreveport, LA request an attorney for judicial commitment proceedings in accordance with all terms, conditions, provision and the schedule of this solicitation, for the period from January 1, 2008 or date of award through September 30, 2008. A VA security check is required. Required information for the VA security check is as follows: name of individual, address, date of birth and social security number. If the candidate has had a VA security check in the last five years, provide the evidence. Authority: This procurement is executed under Enhance Sharing Authority, Public Law 104-262, Title 38 U.S.C. 8153. PRICING FOR BASE YEAR: DESCRIPTION EST. UNIT UNIT TOTAL QTY PRICE PRICE Judicial Commitment Proceeding 24 Cases $_______ $__________ Total for Option 2 $____________ Description of Duties: The contractor shall perform, but is not limited to, the following services: Prepare and present cases for hearing Advise VA staff regarding legal issues pertaining to judicial commitment Research legal issues Respond to requests for information from attorneys File and hear all matters pertaining to judicial commitments Credentials: Provide proof of Licensed to practice law in the state of Louisiana. Contractor Personnel Security Requirements: All contractor employees who require access to the Department of Veterans Affairs' computer System shall be the subject to a background investigation and must receive a favorable adjudication from the VA Office of Security and Law Enforcement prior to contract performance. 1. Position Sensitivity - The position sensitivity has been designated as Low Risk. 2. Background Investigation - The level of background investigation commensurate with the required level of access is National Agency Check with Written Inquiries. 3. Government Responsibilities a. The VA Office of Security and Law Enforcement will provide the necessary forms to the contractor or to the contractor's employees after receiving a list of names and addresses. b. Upon receipt, the VA Office of Security and Law Enforcement will review the completed forms for accuracy and forward the forms to OPM to conduct the background investigation. c. The VA facility will pay for investigations conducted by the Office of Personnel Management (OPM) in Advance. d. The VA Office of Security and Law Enforcement will notify the contracting officer and contractor after adjudicating the results of the background investigations received for OPM. e. The contracting officer will ensure that the contractor provides evidence that investigations have been completed or are in the process of being requested. Stoner Avenue Shreveport, LA 71101 Phone: (318) 424-6860 Services: a. The service specified in this contract can only be changed by written modification prepared by the VA Contracting Officer. b. The services to be performed by the contractor will be performed in accordance with VA policies and procedures and the regulations of the medical staff by-law of the VA facility. c. The services to be performed by the contractor will be under the direction of: Chief of Staff, Overton Brooks VA Medical Center, Shreveport, LA. Qualifications: a. The contractor to perform the services covered by this contract shall have an unrestricted license to practice law in the state of Louisiana. The qualifications of such personnel shall also be subject to review by the VAMC Chief of Staff and approval by the VAMC Director. b. Personnel assigned under this contract shall be licensed in accordance with the terms of this contract (See Credentials). c. Possess basic proficiency in spoken and written English in accordance with public law 95-201. Terms of the Contract: Services shall be provided at the Overton Brooks VA Medical Center, 510 East Stoner Avenue, Shreveport, LA 71101 from January 1, 2008 through September 30, 2008 with 2 option periods. Personnel Policy: The parties agree that the contractor shall not be considered a VA employee for any purpose. Proof of professional liability insurance shall be required before award. Contractor Performance Monitoring: The Chief, Mental Health Service (116) will be responsible for monitoring the quality of service provided under this contract. Contract Monitoring Procedures a. At the time of contract award the Contracting Officer will appoint a Contracting Officer Technical Representative (COTR) to assist with the contract monitoring requirements. The COTR will monitor such items as quality of service, timeliness of performance, customer service, cost control, and business relations. b. The COTR will ensure that services are performed and be responsible for handling service related requirements necessary for patient care. Such documentation may include any appropriate records that verify services called for under the contract have been performed by the contractor. c. The delegated COTR will notify the Contracting Officer of any non-compliance immediately upon his/her gaining knowledge of any such situation or incident. Initiate communication may be communicated by telephone. After such communication, the COTR will provide a written statement to the contracting officer along with any supporting documentation regarding the performance failure noted. d. Upon receipt of a proper invoice, the COTR shall certify that the services identified have been performed. Once certification has been made, the invoice will be forward through the proper billing channels and payment shall be made to the Contractor. e. It is the intention of both parties to conduct joint reviews prior to the expiration date of the contract to determine and evaluate if services being provided are in accordance with the contract terms, payments and billings are being properly handled and to jointly determine if this agreement is satisfactory to both parties in terms of services provided and consideration being received. This review may include, but not be limited to: analyze all billings, payments, costs, administrative issues, patient satisfaction, quality of care and other related documentation that identifies that services has been received. f. Upon conclusion of the initial contract period, and in coordination with the Contracting Officer, the using service shall provide a statement to the Contracting Officer providing a summary of contractor actions and a statement that all requirements of the contract were fulfilled as agreed. This information shall be forwarded by the COTR to the Contracting Officer at least 90 days prior to contract expiration. g. Coordinate all required mandatory training for contract employees and document their file. Method of Award: Award will be made to the offeror whose candidate is most qualified, whose quote conforms to the requirements of the solicitation and has the lowest price, all factors being considered. Award may not necessarily be made to the offeror submitting the lowest price. Award made be made without discussions. Contracts may be awarded to one or more vendors. Use of Cell Phones a. The following list of areas will have signs posted in visible areas, which read, "For Patient Safety Please Turn Off Cellular Phones and Personal Electronic Devices" Signage must be clearly visible in areas where cell phone usage is restricted. 1E Emergency Room 3N SICU 3W Surgery 4N CAT Scan 6E Patient Care Areas 6N MICU 6W Inpatient Area BE Radiation Oncology b. A sign posted in every entryway and lobby will state the following, "Cell phone usage is permitted except for posted areas." c. Use of cell phones and personal electronics is not allowed within six feet of any active medical device for any reason, even if signs are not posted.
