Contracting Office Address: Department of Commerce, National Institute of Standards and Technology (NIST), Acquisition Management Division, 100 Bureau Drive, Building 301, Room B129, Mail Stop 1640, Gaithersburg, MD, 20899-1640, UNITED STATES Description: This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in FAR Parts 12 and 13, as supplemental with additional information included in this notice. This announcement constitutes the only solicitation, quotes are being requested and a separate written solicitation will not be issued. Solicitation Number SB134108RQ0250 is issued as a request for quotation. The North American Industry Classification Code (NAICS) is 541199 with a small business size standard of $6.5 million. THIS REQUIREMENT IS RESTRICTED AND ONLY SMALL BUSINESS CONTRACTORS MAY SUBMIT A QUOTE. The NIST Technology Services Division has a requirement for preparation, submission and prosecution of a Non-Provisional Patent Applications and an Accelerated Patent Application for the following National Institute of Standards and Technology (NIST) Invention. Independently and not as an agent of the Government, the Contractor shall provide services in accordance with the Statement of Work (SOW), Preparation, Submission and Prosecution of a Non-Provisional Patent Application for the following NIST Invention. ---BEGINNING OF THE STATEMENT OF WORK--- I. Invention Abstract The invention deals with the challenge of void-free filling of recessed surface features on non-planar metallized surfaces with iron group magnetic materials. Specifically, the addition of certain benzimidazole derivatives to a conventional additive-free nickel plating baths (e.g. Watts bath) NiS04-NiCli, results in a superconformal deposition growth mode. By superconformal deposition we mean that metal deposition occurs preferentially in recessed surface features, such as patterned trenches and voids, thereby resulting in void-free filling (please see slide in attached Power Point File 2003 (ppt)). By appropriate patterning and design a variety of fully consolidated 3-D shapes and geometries can be fabricated. The resulting structures have potential use as micro-magnets for microelectromechanical devices as well as active magnetic material components for use in a variety of information storage devices. The process may also be useful in the deposition of Ni and related metals as a precursor to forming silicide contacts in microelectronics. II. Background In carrying out its responsibilities to promote technology transfer under the Stevenson-Wydler Act of 1980, as amended by the Federal Technology Transfer Act (FTTA) of 1986 as amended, the National Institute of Standards and Technology (NIST) through its Office of Technology Partnerships (OTP) often seeks patent protection for inventions developed in its laboratories during the course of scientific and technical activities carried on in support of the NIST mission. The decision to file a non-provisional patent application for a specific invention is made when NIST determines that a patent for the invention will significantly enhance the technology transfer/commercialization attractiveness of the invention to the private, for-profit sector. III. Scope of Work The work to be delivered under this SOW by the contractor shall include all necessary supporting research, preparation, submission and prosecution of a non-provisional U.S. patent application for the above referenced NIST invention. IV. Task Task 1 - Conduct all supporting research that, in the professional judgment of the Contractor, is necessary to prepare a non-provisional U. S. patent application. This shall include the following: a. Review of all technical material submitted by the NIST inventor concerning the invention with the inventor(s). b. Render an opinion concerning the patentability of the invention. Task 2 - Prepare the patent application and all necessary supporting documentation in preparation for filing at the U. S. Patent and Trademark Office (USPTO). This will be accomplished with final approval on patent application content rendered by the first NIST inventor as named on the application. Task 3 - File non-provisional patent application with the USPTO. This shall include but not be limited to the following: a. Contractor shall file the patent application with all pertinent ink drawings and diagrams with transmittal papers with the US PTO along with an executed Declaration and Power of Attorney, and shall report the completion of this action to the NIST Technical Information Contact (TIC). b. Contractor shall request an immediate Publication by the USPTO after the effective date of application submission patent award. c. Contractor shall request the Information Disclosure Statement when the application is filed. d. Contractor shall send to the NIST TIC an electronic copy of the invention’s non-provisional patent application as filed with the US PTO immediately after the application’s filing. Task 4 - Election and preparation of Response to Restriction Requirements a. Contractor shall provide an Analysis Letter to accompany the Response to First Office Action to include receipt, review, reporting, preparation and filing of response and reporting. b. Contractor shall provide an Analysis Letter to accompany the Response to Second Office Action and all subsequent office actions to include Final Office Action, to include receipt, review, reporting, preparation and filing of response and reporting. Task 5 - Electronic Copy of Claims Contractor shall provide an Electronic Copy of Claims as added, deleted and/or modified in Response to Office Actions after Response is filed with the USPTO. Contractor shall provide the filing of Drawings Amended according to the Allowed Claims. Contractor shall provide the Response to Notice of Filing Missing Parts of Application. Contractor shall receipt, review and provide to the NIST TIC Reporting of Notice of Allowability. Contractor shall review the file wrapper for any outstanding items and resolve any outstanding issues with the USPTO. Contractor shall conduct a USPTO Examiners interview. The interviews can be conducted in person or by telephone. V. Deliverables The highly variable nature of the patent process and the large, diverse number of necessary interim work products often required to support the preparation, submission and prosecution of a patent application, make it difficult to specify the exact number, type and content or these work products or to prepare a schedule for their production and delivery. The following deliverable products have been identified for production and delivery to the intended recipients during this contract: V.1-Non-Provisional Patent Application suitable for timely submission to the USPTO with all required supporting forms, declarations and other documentation. V.2-All submissions, e.g., amendments to the application, prepared by the Contractor in response to first, second and subsequent office actions taken during the patent prosecution by the USPTO. V.3-All supporting drawings and diagrams intended for filing with the Non-Provisional Patent Application or in response to subsequent office actions. V.4 Appellate documents files after Final Office Action. V.5 The Contractor’s case file for the entire patent prosecution, to include all attorney correspondence with the USPTO. VI. Government Furnished Property All technical documentation to include drawings, data, invention descriptions, articles, and technical and administrative memoranda concerning the invention that may be necessary input to the preparation and prosecution of the patent application. ---END OF THE STATEMENT OF WORK--- PERIOD OF PERFORMANCE: This purchase order is for a five (5) year period from date of award. PRICE QUOTE: Please submit a firm-fixed price to complete this patent application work and a fully burdened hourly rate and number of hours used to derive the price. Upon request, the Government will provide technical documentation to include drawings, data, invention descriptions, invention disclosure, articles, and technical and administrative memoranda concerning the invention for necessary input to the preparation and prosecution of the patent application. THE TECHNICAL INFORMATION CONTACT (TIC): To be determined by NIST PLACE OF PERFORMANCE: Contractor site. The resulting purchase order shall be negotiated on a firm fixed-price basis. The award shall be made on a best value basis. The best value evaluation factors while relatively equal are listed in order of importance, include the following: 1) Approach - The likelihood of effectively meeting the requirements; 2) Past Performance - The relevance and quality of prior performance; and 3) Price - The amount, realism and consistency of the evaluated price. The evaluation shall be based on use of the adjectival scheme as follows: Outstanding (O) - Conspicuously striking in eminence; Excellent (E) - Very good of its kind; eminently good, superior or first class; Good (G) - Beneficial and worthwhile; sound and valid; Adequate (A) - Reasonably sufficient and suitable; Marginal (M) - Minimally suitable at the lower limit; Unsatisfactory (U) - Not acceptable, not adequate to carry out. The solicitation document and incorporated clauses are those in effect through Federal Acquisition Circular Number 2005-24. The provisions and clauses may be downloaded at http://www.acquisition.gov/far/index.html. The following provisions and clauses shall apply to this solicitation. FAR 52.212-1, Instructions to Offerors - Commercial, applies to this acquisition and there is no addenda to this provision; FAR 52.212-2, Evaluation - Commercial Items. The Government shall award a purchase order resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (i) approach, (ii) past performance, (iii) price; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items, applies to this acquisition and there is no addenda to this provision; FAR 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition and there is no addenda to this provision; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items, applies to this acquisition; FAR 52.204-9, Personal Identity Verification of Contractor Personnel; FAR 52.227-14, Rights in Data - General; 52.217-8 Option to Extend Services; 52.217-9 Option to Extend the Term of the Contract and other appropriate clauses as needed. All interested contractors must be actively registered in the Central Contractor registration (CCR) database (www.ccr.gov); AND provide a completed copy of the Offeror Representations and Certifications. Interested contractors are invited to review the above Statement of Work for: Preparation, Submission and Prosecution of a Non-Provisional Patent Application for NIST Invention: “Superconformal Electrodeposition Of Ni-Fe-Co Magnetic Alloys.” (NIST Docket #08-001) Responses are to be received electronically no later than 5:00pm, Eastern Time, on May 1, 2008. The electronic version shall be in the form of an email with attachments. Contractors must submit a complete response. Responses that are not substantially complete will be returned. Offers of partial performance shall be rejected. Responses are to be emailed to George Ralis (george.ralis@nist.gov), Contract Specialist, NIST. Submit quotes arranged in three sections as follows: SECTION I – Approach: Which includes identification and qualifications of relevant personnel and technical management approach; SECTION II - Past Performance: For relevant experience which describes at least three (3) relevant projects performed in the last three years and quality of performance; SECTION III – Price: Firm fixed-price for the required technical consulting services. Each firm fixed-price shall include sufficient data to allow the Government to determine the amount, realism and consistency of the fixed price. Award shall be made to the responsible contractor that offers the best value to the Government. The Government shall not be liable for any costs incurred in response to this request. The Government reserves the right to make a single award, multiple awards, or no award as a result of this RFQ. It is the responsibility of the contractor to confirm NIST's receipt of quote.
