- The Department of State anticipates the competitive award of a one-year base plus four one-year option period follow-on requirements contract to provide a source of Workers' Compensation Insurance as required by the Defense Base Act (DBA). Under this follow-on program, the requirement to provide overseas contractor employees with insurance coverage pursuant to the Longshoremen and Harbor Workers' Compensation Act/ Defense Base Act would be done by a single insurance carrier during the contract duration, for all eligible Departmental contractors unless a waiver has been obtained from the U.S. Department of Labor. The successful insurance carrier shall deal directly with the companies requiring DBA insurance for payment arrangements and resolution of issues. No Government funds will be allocated under any agreement or contract for performance of this program. Reimbursement/premiums for DBA insurance will come from individual Department of State contracts requiring DBA coverage. The purpose of this contract is to provide a source of Worker's Compensation Insurance (excluding the Aviation Support Services Contract) as required by the Defense Base Act (DBA). Under all Department of State (DOS) financed service and construction contracts, involving any overseas performance, the contractor is required by law to provide overseas employees with such insurance pursuant to the Longshoremen and Harbor Worker’s Compensation Act (commonly called the "Defense Base Act" or "DBA") (42 U.S.C. 1651 e t seq.). DBA insurance coverage applies to individuals employed under DOS Contracts or subcontracts or subordinate contracts regardless of the duration of their assignment, and is over and above any State Worker's Compensation Insurance coverage. DBA insurance coverage is required for employees of contractors (and their subcontractors) unless a waiver has been obtained from the U.S. Department of Labor (See FAR 28.305). However, the waiver does not apply to any employee who is: a. Hired in the United States; b. A resident of the United States; or, c. A citizen of the United States. A fixed-price, requirements type of contract for the services specified and for the period stated is anticipated. All DOS contractors procuring DBA insurance (i.e. renewing coverage or obtaining new coverage) for a DOS financed contract, or subcontract at any tier which require overseas services, are required by Department of State Acquisition Regulation (DOSAR) and the terms of their contracts to purchase such DBA insurance under this requirements contract. DOS non-personal services contracts with individuals are also subject to DBA coverage. Personal Services Contractors (PSCs) are exempt from Defense Base Act coverage; they are covered by the Federal Employees Compensation Act. All DOS direct contractors must procure DBA insurance under this requirements contract unless they are a DBA self-insurance program approved by the Department of Labor.
