- JUSTIFICATION AND APPROVALFOR OTHER THAN FULL AND OPEN COMPETITION Upon the basis of the following justification, I hereby approve the issuance of the contracl action described below using other than full and open competition, pursuant to the authority cited herein. 1. Contracting Activity Department of Veterans Affairs Austin Information Technology Center IT Acquisition Center Austin, TX 78772 2. Description of Service and Supplies: The Department of Veterans Affairs, Office of Dentistry plans to contract with Symbologic, Inc. for programming and software maintenance on a sole source basis for VHA Central Dental Laboratories Production and Tracking Application Software. 3. Statutory Authority: FAR 6.302-1 and 41 U.S.C. 253(c)(1) only one responsible source and no other supplies or services will satisfy agency requirements. 4. Rationale Supporting Use of Authority Cited Above: Symbologic, Inc. was the contractor that developed this software for the VA and has been maintaining the software for the Central Dental Laboratory Reporting System since 1984. Although the VA owns the software, Symbologic is uniquely qualified to provide the programming and maintenance support as there would be a substantial duplication of cost to the Government that is not expected to be recovered through competition for another contractor to come up to speed and be able to maintain and provide the application enhancements to the software required by this contract. 5. Efforts to Solicit Potential Sources; Market Research Conducted; and Sources which expressed interest in writing: This requirement will be posted in FedBizOpps.. 6. Determination of Fair and Reasonable. The Contracting Officer has determined that the anticipated cost to the Government will be fair and reasonable based on historical data, price analysis, and negotiations. 7. Other Supporting Data: Commercial off-the-shelf dental laboratory software has been reviewed in the past to determine if it meets the needs of the Central Dental Laboratory. Due to operational differences between private sector dental p. 2 labs and federal dental labs, the COTS software does not capture the data needed by the Central Dental Lab and VACO Office of Dentistry. 8. Barriers to competition for subsequent acquisitions: Maintenance and enhancements of this software after this contract period will be assessed for competition as deliverables required under this contract are the full documentation of the system with administrator and end user manuals as well as proof of concept transition to a central database. The Government may be in a position to maintenance the software in house or have adequate documentation for another contractor to provide maintenance after this contract period of performance is complete.
