- The National Cancer Institute (NCI) plans to procure as a sole source the brand LSR 11 4 Laser Flow Cytometric System with BD Biosciences Inc.; 2350 Qume Drive; San Jose, CA 95131. This acquisition will be conducted under the procedures for acquiring commercial items authorized in FAR Part 12 and under the authority to use simplified procedures for commercial requirements as provided in FAR 13.501. The North American Industry Classification System code is 334516 and the business size standard is 500 employees. This notice is not a request for competitive quotation. However, if any interested party believes it can meet the above requirement, it may submit a statement of capabilities. The statement of capabilities and any other information furnished must be in writing and must contain material in sufficient detail to allow NCI to determine if the party can perform the requirement. No faxed or emailed capability statements will be accepted. Contractor shall provide one (1) original and one (1) copy of the capability statement. Capability statements must be received in the contracting office by 1:00 PM EST, by July 25, 2008. It is the vendors' responsibility to ensure all questions have been received in the contracting office. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No collect calls will be accepted. In order to receive an award, contractors must be registered and have valid certification in the Central Contractor Registration (CCR) and the Online Representations and Certifications Applications (ORCA). Reference: NCI-80123-MM on all correspondence. Part I: Background information and description of requirements: The Metabolism Branch supports a large program of basic and clinical research involving patients with malignancies of the immune system. This work includes the development of new patient therapies which involves not only the study of individuals enrolled in clinical trials but also toxicity studies in subhuman primates and models of human disease developed in mice. Such studies require the ability to isolate and evaluate specific subsets of circulating hematopoietic cells based on the phenotypic expression of their cellular receptors and cytokines. The identification of these cellular populations involves flow cytometric analysis capable of detecting eight fluorescent parameters simultaneously on a single cell, a capability which we currently do not have. This instrument will provide the capacity to monitor as many as ten fluorescent signals simultaneously. In addition, the UV laser configured in this instrument will enable NCI to extend our studies to include critical monitoring of calcium mobilization in live cells following cytokine stimulation. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION: Part II: Facts and Reasons to Justify Other than Full and Open Competition: Statutory Authority Statute: This justification has been prepared under the authority of 41 U.S.C. 253 (c)(1) as set forth in 13.106-1 (b)(2) and 13.501(a)(1). (b) Soliciting from a single source. (2) For sole source acquisitions of commercial items in excess of the simplified acquisition threshold conducted pursuant to subpart 13.5, the requirements at 13.501(a) apply. No other requirement and/or type for supply or service will satisfy agency need. Justification: The NCI's current flow cytometric patient studies are analyzed using three existing BD Bioscience instruments in our Branch. It is essential that the new, upgraded 4 laser instrument be compatible with the existing instruments both in hardware technology and software for data analysis in order to insure comparability between previous and future critical patient studies. Such data acquisition software is proprietary to the individual manufacturer and cannot be used with instrumentation from different companies. In addition, several of our research collaborators also use the LSR11 system which will provide the ability to exchange and analyze data on a unified platform. For these reasons it is essential that BD Biosciences be the sole source contractor for the purchase of this 4 laser flow cytometric system. The following salient characteristics apply to the LSR II: 1) Solid-state 488nm blue laser to detect FSC and SSC scatter parameters and FITC/Alexa 488, PE, PerCPCY55, and PECY7 fluorochromes or dyes (4 colors) 2) Red laser to detect APC and APCCY7 fluorochromes or dyes (2 colors) 3) Violet laser to detect Pacific Blue and Am cyan fluorochromes or dyes (2 colors) 4) UV laser to detect INDO 1 BLUE and INDO 1 Violet/DAPI fluorochromes or dyes (2 colors) 5) LSR 11 XW4600 workstation bundle with two 19 inch LCD monitors for digital data acquisition allowing for inter and intra beam compensation and the ability to threshold on any parameter 6) Appropriate dichroic mirrors and bandpass filters configured to detect the above indicated scatter patterns, fluorochromes, or dyes
