- 2.2 SPECIAL CONTRACT REQUIREMENTS Under the authority of Public Law 104-262 and 38 USC 8153, the contractor agrees to provide Health Care Resources in accordance with the terms and conditions stated herein, to furnish to and at the Department of Veterans Affairs Medical Center, Leeds, MA 01053, the services and prices specified in this contract. 1. Resources: a. The resources specified in Sections B and C may be changed by written modification to this contract. The modification will be prepared by the VA Contracting Officer. b. The resources specified in Sections B and C of this contract shall be furnished to the VA by the contractor when requested by means of an individual written request which has been authorized by the Program Manager, Diagnostic Services. 2. Length of Contract: The contract will be from February 1, 2009 to January 31, 2014 with four 1 year options. No services will be furnished after September 30th each year, without written authorization of the Contracting Officer. This is subject to the availability of fiscal year funding. 3. Qualifications: The contractor performing the services covered by this contract shall be licensed in a State, Territory, or Commonwealth of the United States or the District of Columbia, and shall be board certified or board eligible in Radiology. The Contractor shall be proficient in spoken and written English in accordance with Public Law 95-201. The qualifications of such personnel shall be subject to the credential and privileging process which includes submission of personal information into the VAs electronic credentialing database called VetPro, review by the VA Chief of Staff and approval by the VA Facility Director. In addition to the above, the following shall be provided by the contractor for each radiologist: 1. State license, 2. Credentials required for privileging, 3. Current board certification/board eligible certification, 4. CV (resume) containing all pertinent data supporting professional qualifications, experience and education, 5. Current malpractice insurance certificate. 6. Documentation of Hepatitis B immunization, or declination of same, and evidence of immunity to measles, mumps and rubella. 7. Documentation of annual tuberculosis screening. This should include a PPD, unless the employee has a history of positive PPD, in which case, a chest x-ray should be on file and an annual medical chest evaluation should be documented. 8. Documentation of CPR certification, BCLS at a minimum. 4. Work Hours: a. The services covered by this contract shall be furnished by the contractor as defined herein. The contractor will not be required to furnish such services on a national holiday or during off-duty hours as described below. b. These terms have the following meanings: (1)Work Hours: Monday through Friday, 8:00am to 12:00 pm (2)National Holidays: The 10 holidays observed by the Federal Government, i.e., New Year's Day, Presidents' Day, Martin Luther King's Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving and Christmas, and any other day specifically declared by the President of the United States to be a National holiday. (3)Off-Duty Hours: Any hours other than "Work Hours", Item b (1), above. 5. Personnel Policy: a. The contractor shall be responsible for self-protection under this contract. To carry out this responsibility, the contractor shall provide the following: Workmen's Compensation Professional Liability Insurance Health Examinations, including Hepatitis Type B immunization, and annual tuberculosis screening. Income Tax Withholding Social Security Payments b. The contract Radiologist is in good health and free of communicable disease as evidenced by a Declaration of Physical Health. c. The contractor shall ensure that every radiologist has an active and valid medical license. The parties agree that such personnel shall not be considered VA employees for any purposes and shall be considered an employee of the contractor. 6. Monitoring Procedures: A sign-in log will be maintained in the Radiology Department. The contractor must sign the log and note the date and time of arrival prior to the beginning of the work hours for the services requested. At the end of the work hours, the contractor will sign out and note the time of departure. The radiology department will verify the above information. Any incidents of contractor noncompliance, as evidenced by the monitoring procedures, shall be forwarded immediately to the Contracting Officer. 7. Designated COTR: The Program Manager, Diagnostic Services, is the designated Contracting Officers Technical Representative (COTR). The responsibilities include the review and evaluation of the applicable services. The COTR also requests any receipts for services rendered. This designation is specifically limited to requesting for contract services. Any commitments or changes which affect the price, quantity, quality or delivery terms and the authority to amend, render decisions on question of fact in dispute and related contract administration problems are duties of the Contracting Officer and cannot be delegated. The Contracting Officer will delegate a COTR upon award of this contract. SERVICE: Provide the professional component for the following exams at the estimated yearly quantities listed in accordance with the requirements of this contract. The services and quantities listed are estimates only and additional services may or may not be required. Contractor will be required to provide these services on an hourly basis, using on-site computed radiography equipment, i.e., two radiographic suites (one with fluoroscopy), CT scanner (16 slice), ultrasound unit, bone density scanner (DEXA), portable X-ray unit, and CareStream PACS with PowerScribe voice recognition system. 1. Diagnostic x rays ~ 4,500 the majority being chest and skeletal 2. Ultrasound exams ~1,500 both diagnostic and vascular 3. CT exams ~1,400 4. Bone density exams ~300 Section B - Performance Requirements These performance requirements will be monitored by the VA and results will be shared with the contractor. 1. Acceptable quality level: 90% of reports must be verified within 48 hours of the exam registration Monitoring method: A monthly turn around time report will be run by VA to collect individual and group data. Disincentive: All reports verified within 48 hours will be paid at 100% of invoice rate. Cases less than 90% will be paid at a rate two (2) times the percent of cases exceeding 48 hour completion. Example: 100 cases in month and 88 cases were verified within 48 hours or 88%, which is 2% lower than the expected rate of 90%. If bill for month is $10, 000, it would be reduced by 4 % or $400 2. Acceptable work level: quarterly productivity of at least 625 RVUs for 0.5 FTE (VHA Directive 2008-009) Monitoring method: A monthly report will be run and data is analyzed quarterly by the VA. Disincentive: RVUs less than 625 for 0.5 FTEE for the quarter will result in a decrease in invoice by $50 per RVU less than 625 Exception: Equipment failure 3. Peer Review: This is a required function of all radiologists. Data is collected by the physician COTR and shared with individual radiologists and the contractor. Data is used in re-privileging. SECTION C - DESCRIPTION/SPECS/WORK STATEMENT 1. Services to be performed shall include written diagnostic interpretations for exams performed by radiologic technologists which include diagnostic x-rays, fluoroscopy, ultrasound, CT, and bone density. Radiologist must perform intravenous access for contrast injection. All image interpretations are required to be by computer monitor (filmless). A voice recognition dictation system is required to be used. Normal working hours will be 8am 12:00 pm, Monday through Friday, excluding National Holidays. Contractor shall be present and performing the required services at the Medical Center for the period specified. 2. All exams shall be read and signed within 48 hours, and emergency exams shall be read and signed during the same day. The contractor shall assume compliance responsibility for current JCAHO Standards and other VA regulations as pertains to the professional service activities, such as quality assurance and utilization review activities. VA policies will be available upon request. The contractor shall also provide technical direction over appropriate elements of the service, attend required conferences and be available for consultation with staff physicians. All work shall be performed at the VA Medical Center, Leeds, MA. Work shall be performed under the direction of the Program Manager, Diagnostic Services. 3. Clinical privileges must be granted by this Medical Center, utilizing current VA regulations, before any services can be provided under this contract. Medical staff membership will automatically terminate with the termination of this contract. This does not preclude termination of individual provider privileges or any other process described in the Medical Staff Bylaws and Rules. 4. The contractor shall provide coverage for the period specified in case the primary personnel is not available. All radiologists working under this contract must comply with all the requirements under this solicitation/contract. Any incidents of contractor non-compliance will be forwarded immediately to the Contracting Officer. 5. The contractor shall comply with all VA computer security policies and confidentiality policies. The contractor shall guarantee total confidentiality of all VA Medical Center records and information contained therein and all other related materials (reference FAR 52.224-2). 6. "CONTRACTOR PERSONNEL SECURITY REQUIREMENTS" All contractor employees who require access to the Department of Veterans Affairs' telecommunications systems shall be the subject of a background investigation and must receive a favorable adjudication from the VA Office of Security and Law Enforcement prior to contract performance. This requirement is applicable to all subcontractor personnel requiring the same access. If the investigation is not completed prior to the start date of the contract, the contractor will be responsible for the actions of those individuals they provide to perform work for VA. 1. Position Sensitivity - The position sensitivity has been designated as Low Risk. 2. Background Investigation - The level of background investigation commensurate with the required level of access is Minimum Background Investigation. 3. Contractor Responsibilities a.The contractor shall bear the expense of obtaining background investigations. If the investigation is conducted by the Office of Personnel Management (OPM), the contractor shall reimburse VA within 30 days. b.The contractor shall prescreen all personnel requiring access to the telecommunications systems to ensure they maintain a U.S. citizenship and are able to read, write, speak and understand the English language. c.The contractor shall submit or have their employees submit the following required forms to the VA Office of Security and Law Enforcement within 30 days of receipt: (i) Standard Form 85P, Questionnaire for Public Trust Positions (ii) Standard Form 85P-S, Supplemental Questionnaire for Selected Positions (iii) FD 258, U.S. Department of Justice Fingerprint Applicant Chart (iv) VA Form 0710, Authority for Release of Information Form (v) Optional Form 306, Declaration for Federal Employment (vi) Optional Form 612, Optional Application for Federal Employment d.The contractor, when notified of an unfavorable determination by the Government, shall withdraw the employee from consideration from working under the contract. e.Failure to comply with the contractor personnel security requirements may result in termination of the contract for default. 4. Government Responsibilities a.The VA Office of Security and Law Enforcement will provide the necessary forms to the contractor or to the contractor's employees after receiving a list of names and addresses. b.Upon receipt, the VA Office of Security and Law Enforcement will review the completed forms for accuracy and forward the forms to OPM to conduct the background investigation. c.The VA facility will pay for investigations conducted by the Office of Personnel Management (OPM) in advance. In these instances, the contractor will reimburse the VA facility within 30 days. d. The VA Office of Security and Law Enforcement will notify the contracting officer and contractor after adjudicating the results of the background investigations received from OPM. e. The contracting officer will ensure that the contractor provides evidence that investigations have been completed or are in the process of being requested. "
