- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested by this notice alone, and a written solicitation will not be issued. This procurement is a small businesses set aside. The NAICS code for this action is 541211. The solicitacion number for this acquisition is 263-2009-FX-0302. This solicitation includes all applicable provisions and clauses in effect through FAC 05-15. This acquisition will be made pursuant to the authority in FAR 13.5 to use simplified procedures for commercial requirements. This synopsis/solicitation is issued as a Request for proposals for audit of Abbott Molecular License. The period of performance is 10 days after the award date, the final day of the period of performance should be 120 after the start date. The NIH Office of Technology Transfer (“OTT”) requires the services of a royalty auditing firm (“Contractor”) to audit the sales and financial records related to licensed products of an NIH licensee (“Licensee”) at their place of business in order to determine if OTT has received the proper amount of royalty payments specified under their license agreement for use of NIH technologies. In addition, the Contractor shall help ensure that the Licensee is in compliance with other terms of the license agreement. Provision 52.252-1 Solicitation Provisions Incorporated by Reference. Offerors shall include a complete copy of the provision at 52.212-3 Offeror Representations and Certifications. Commercial Items with their offer. The Government intends to make a single award to the eligible, responsible offeror whose offer conforms to the solicitation and is the most advantageous to the Government. Award may be based on the basis of initial proposal submitted without conduction any discussion, therefore initial proposal should be submitted on the most favorable terms possible to the Government. The evaluation will be based on the demonstrated capabilities of the prospective contractors in relation to the needs of the project as set forth in this RFQ. The merits of each proposal will be evaluated carefully. The Evaluation Criteria is as Follows: 1. Understanding of the auditing requirement and proposed technical approach to conducting the necessary royalty audits. (35 points) ● Understanding internal billing procedures, including assignment and management. ● Methodology used during the initial evaluation and in determining if further investigation is necessary. ● Assurance that no conflict of interests persist and that such conflicts are avoided throughout performance of the requirement. 2. Personnel (35 points) ● Qualification of proposed staff. ● Suitability and adequacy of each auditor (provide names, telephone numbers and contact persons for each auditor as well as other supporting documentation) proposed with regard to education, training and experience in conducting royalty audits. ● Availability of proposed personnel for assignment to this project. 3. Corporate and organizational experience in auditing licenses and royalty auditing (30 points) ● Experience conducting previous royalty audits to ensure compliance with license terms. ● Administrative support for such audits. ● Assurance that no corporate conflict of interest exists.
