Description: The National Institute of Standards and Technology (NIST), intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with Applied Biosystems, LLC in Foster City, CA for the purchase of direct replacement parts for the Applied Biosystems equipment currently in use at NIST. The direct replacements shall consist of one (1) Turbo-V 361 Navigator; one (1) Turbo V361 Controller ; one (1) Turbo V902 Navigator and one (1) Turbo V902 Controller. NIST currently has an Applied Biosystems API 4000 and API 4000 Q-Trap that these parts will be direct replacements for use in. Varian Inc. has a policy in place in regards to the sale or exchange of parts manufactured for Sciex/Applied Biosystems by Varian, Inc. which states that direct supply of products and refurbishment services to end users of Applied Biosystems/Sciex equipment or to third party service organizations shall not be practiced or permitted, this also applies to service contracts or maintenance on the said equipment. Therefore, Applied Biosystems is the only source that has authorization to supply these parts and to service the parts after the sale. Delivery shall be FOB Destination, Charleston, SC, and is required within 90 days after receipt of order. The North American Industry Classification System (NAICS) code for this acquisition is 339113, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the Government will consider responses received by January 22, 2010. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
