Description
TITLE: NNA04CI14T SECTEK, Inc.NASA/ARC has a requirement to extend the performance period of the ARC ProtectiveServices Contract for a maximum of ten months (April 1, 2010 - December 31, 2010); saidextension will consist of one two (2) month performance period and seven (7) one-monthoption periods, the exercise of each option being determined by the Government on amonthly basis. A contract modification reflecting this extension will be issued on orbefore March 31, 2010, which is the expiration date of the current protective servicescontract. NASA/ARC intends to extend the period of performance of contract NNA04CI14T, forprotective services which was awarded as a result of full and open competition under aGSA Schedule to SECTEK Inc., on June 1, 2004. This extension is necessary to bridge theperformance period between the end of the current contract and resolution of the currentprotest challenging NASAs agency-wide contract which was awarded on May 20, 2008 forProtection Services (i.e. Security guard services, potential fire/fighting/preventionservices, and potential emergency medical response services).Authorization of this extension has been issued by NASA Headquarters under PIC-09-04A,dated December 29, 2009 which provides a class deviation from the requirements of FAR17.204(e) and NFS 1817.204(e)(iii), limiting the terms of service contracts to five (5)years, including the basic contract and all options. This class deviation applies only toexisting contract requirements that will ultimately be provided under the agency-wideNASA Protective Services Contract (NPSC). NASA is using the authority for Other Than Full and Open Competition provided by 10U.S.C. 2304(c)(1). Because SECTEK, Inc. possesses unique expertise in meeting thesecurity requirements of the Center, no alternate source could adequately provide for themaintenance of the Centers comprehensive security program during this extension period. Award to another source when the agency-wide contract for protective services has beenrecently awarded, and while the resolution of the protest is nearing completion, wouldresult not only in a substantial duplication of cost to the Government that is notexpected to be recovered through competition, but also in unacceptable delays infulfilling the agency's requirement. The Government does not intend to acquire a commercial item using FAR Part 12. This notice of intent is not a request for competitive proposals. A determination by theGovernment not to compete this proposed contract based upon responses to this notice issolely within the discretion of the Government.Notwithstanding this stated intent, interested organizations may submit theircapabilities and qualifications to perform the effort in writing to the identified pointof contact not later than 4:30 p.m. local time on February 19, 2010. Suchcapabilities/qualifications will be evaluated solely for the purpose of determiningwhether or not to conduct this procurement on a competitive basis. Oral communicationsare not acceptable in response to this notice. All questions MUST be in writing andshould be directed to Ms. Drake not later than 4:30 p.m. local time on February 19, 2010.All responsible sources may submit an offer which shall be considered by the agency.An Ombudsman has been appointed.
