- This is a special notice of intent to award a sole source contract using the procedures in Federal Acquisition Regulation FAR Part 13.5, Test Program for Certain Commercial Items, under the authority of the test program for commercial items per section 4202 of the Clinger-Cohen Act of 1996. The U.S. Army Mission and Installation Contracting Command, Directorate of Contracting, Joint Base Lewis-McChord, located in Washington state, has a requirement for semi-annual preventive maintenance services for Varec biogas equipment and related components installed at the Solo Point Wastewater Treatment Plant. The associated North America Industry Classification System (NAICS) Code is 811310 and the Business Size Standard is $7.0 million. The anticipated contract start date is 1 April 2010, and the anticipated duration is for a base period and two 1-year option periods. The Government intends to award a sole source firm-fixed-price requirements contract to Westech Industrial, Inc., DBA Varec Biogas, 162 Theresa Way, Chula Vista, CA as the only qualified source identified to perform the services. Responses and information obtained through the previously-published sources sought notice were considered in this determination. This special notice is for information only. It is neither a request for quotations, request for proposals, nor a solicitation for offers. No contract will be awarded on the basis of responses to this notice. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.
