- This is a notice of intent to sole source by the U.S. Food and Drug Administration (FDA). FDA intends to issue a solicitation to L-3 Communications for FDA’s Emergency Operations Plan and Annexes Pandemic Influenza Radiological. L-3 Communications is the vendor who is currently providing the services for the development of FDA’s Pandemic Influenza Emergency Response Plan under Contract Number HHSF223200730152G. Due to adverse events, and the nature of the work the FDA is seeking a contractor who can support the agency in the development of plans which will provide the agency operational direction and guidance for emergency preparedness and response. The objective of the work is as follows: - finalize the FDA Emergency Operations Plan (FDA EOP) •complete the revision and updating of the FDA Pandemic Influenza Emergency Response Plan and FDA Radiological Emergency Response Plan as Annexes to the FDA EOP; •incorporate relevant sections of the draft 2009 FDA Crisis Management Plan into the FDA EOP; •incorporate into the FDA EOP and/or Pandemic Influenza Emergency Response Annex operational improvement recommendations developed in the after action review of the agency’s response to the 2009-2010 H1N1 influenza outbreak; •complete changes to substantial portions of the FDA EOP and its Pandemic Influenza Emergency Response Annex and Radiological/Nuclear Emergency Response Annex, specifically, agency organizational charts and descriptions of organizational components, essential functions and essential staff; these needed changes are a result of the reorganization of the Office of the Commissioner in late 2009; •complete changes to the incident command structure(s), roles and responsibilities included in the FDA EOP and its Annexes, as appropriate, which are a result of findings from a tabletop exercise and recent agency responses to incidents as well as ongoing agency deliberations; •conduct training for agency emergency coordinators and other appropriate staff on the use of the new FDA EOP and its Annexes during emergencies. In accordance with FAR 6.302-1, the Government is contemplating an award on a sole source basis for the following reasons: a)The vendor L-3 Communications has the type of knowledge and understanding needed in order to begin work on completing the FDA EOP and its Annexes, which includes: the legal, regulatory and public health protection framework within which FDA functions; the agency’s complex organizational structure and the routine as well as emergency-related roles and responsibilities of its individual organizational components; the agency’s role and responsibilities within the National Response Framework and in supporting certain NRF Annexes, Emergency Support Functions, Homeland Security Presidential Directives and other national level mechanisms for preparing for and responding to emergencies involving or impacting FDA-regulated products. L-3 Communications is knowledgeable about the unique challenges facing FDA in implementing and adapting the principles of the National Incident Management System (NIMS) and in developing an Incident Command Structure (s) that will enhance the agency’s capabilities in responding to a multitude of incident types. b)There is a current legitimate need for work on the FDA EOP and its Annexes. c)There exist an immediate need for these service now and future. In addition, if an immediate award is not made, it may result in detrimental emergencies to the FDA’s mission related initiatives. The NAICS code is 541611. This notice is not a request for competitive quotes; no solicitation document is available and telephone requests will not be accepted. However, sources may submit descriptive literature, fully documenting their capability to perform these services, which will be considered by the Agency. A determination to compete this procurement based on response(s) to this notice is solely within the discretion of the Government. A solicitation will be issued to L-E Communications no less than 15 days after the date of this notice unless the Government determines otherwise.
