Description
W52H0909C0082 JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION CMO # 08-542 1. Contracting Agency: U.S. Army TACOM LCMC (RI), Rock Island, IL 61299 7630. 2. Description of Action: This action will result in a firm fixed price with HR Textron Incorporated. The award is projected for the 4th quarter of FY08 AWCF - FY08 funds will be used. An acquisition plan is not required because it does not meet the dollar threshold for an acquisition plan. 3. Description of Supplies/Services: The proposed contract is for the Circuit Card Assembly, NSN: 5998-01-192-4093, P/N: 36065-1. Requirements will include a total quantity of 100 each for an estimated total value of $374,782.00 and two (2) 50 percent options for a total of $749,564.00. 4. Authority Cited: 10 USC 2304 (c) (1) only one responsible source and no other supplies will satisfy agency requirements as authorized by FAR 6.302-1. 5. Reason for Authority Cited: As authorized by FAR 6.302-1, procurement by other than full and open competition is necessary because HR Textron Incorporated is the Sole Source manufacturer of this Circuit Card Assembly. HR Textron is the prime contractor, designer and developer of the Gun Turret Drive System of which this Circuit Card Assembly is a component of this system. They are the only know contractor having the expertise, configuration control and tooling necessary to meet the Government's need. This item is proprietary to HR Textron Incorporated. A competitive Technical Data Package (TDP) is not available. The Government does not own or have the rights to the TDP. The estimated engineering costs are associated with development and qualification procedures required by FAR to compete, this item is estimated at over $100,000.00. Additional costs associated with conducting this process including reverse engineering and analysis (to include the cost for any additional test equipment or fixtures, higher level assemblies and other required items needed to test this part. Plus any costs to test facilities if applicable) to develop and test a TDP qualified to meet our requirements. The cost for this effort is estimated at a minimum $150,000.00. In addition the estimated schedule to develop the required TDP and qualification procedures is expected to be over 24 months. The schedule is based on the estimated number of weeks/months that will be required to perform the above tasks (this includes conducting the actual testing, reviewing the engineering data and preparing a technical report) and finally to determine whether or not a new source has successfully met the qualification process noted above and can be added to the referenced drawings. The timeframe for this effort is estimated at a minimum of 24 months. There is no funding available to qualify a new source. If a customer would wish to explore this option and provide the funding to qualify a new source, then the design activity may trigger a process to do so. However, keep in mind that even if a new source were to be pursued, the end outcome may not be fruitful. This item is only required on the M1A1 Abrams Tank and is reaching a point where demand is decreasing. Deliveries are required as soon as possible. Therefore award of this requirement cannot possibly be delayed for 24 months awaiting qualification of another source. 6. Efforts to Obtain Competition: This requirement will be synopsized in FedBizOpps to further increase subcontracting opportunities as required by FAR 5.201 (c). 7. Actions to Increase Competition: Competition will not increase because the cost to acquire the TDP is prohibitive. This item is specific to the M1 Abrams Tank and is only available from HR Textron. Funds are not available to purchase the TDP, to reverser engineer this item, or to prepare performance specifications for this item. 8. Market Research: Market Research was performed on 28 July 2008 the assigned engineer, based on an inadequate TDP and on his expertise and knowledge made a technical evaluation that there is no commercial equivalent to satisfy this requirement. 9. Interested Sources: To date, no other sources have expressed an interest in writing. 10.
