- SPECIAL NOTICE The VA Medical Center, Surgical Services (Operating Room) located at the West Roxbury Campus, of the Boston Healthcare System, MA, had an urgent and compelling need for specific equipment for the DaVinci Robotic OR System. Intuitive Surgical, Inc. is the only manufacturer/distributor of this equipment for the DaVinci Robotic Surgical System. FAR 6.302-1, USC 253(c)(1) Only One Responsible Source, will meet the agencies requirement and time constraint. VA West Roxbury surgical staff are currently using this equipment for non-evasive prostate cancer surgeries. The system requires specific equipment to be replaced every ten surgeries. The WR OR scheduled two surgeries on 3/25/2010 and would not have enough equipment to perform the surgeries if one component had failed and/or/broke during the procedure. Back-up equipment is urgently needed. The request was received in the Contracting Office on 3/22/2010. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1.Identification of the agency and the contracting activity. VA Boston Healthcare System - West Roxbury Campus Surgical Service. 2.Nature and/or description of the action being approved. Urgent procurement of Davinci Instrumentation (scissors, needle driver from Intuitive Surgical. Instrumentation is needed within two days for two surgical procedures. PR #523-10-2-7910-1147 Intuitive surgical Inc 1266 Kifer Rd Sunnyvale, CA 94086 3.Description of the supplies or services required to meet the agency's needs (including the estimated value). The Intuitive DaVinci surgical 3D HD endoscopy system is robotic technology enabling the surgeon intuitive motion. This system virtually extends the surgeon's eyes and hands into the surgical field, preserving natural eye-hand instrument alignment and intuitive instrument control, giving the patient minimally invasive surgical procedures for treatment of prostate cancer. These specific instruments are used in conjunction with other instrumentation and the Davinci equipment already on station. Not to use these specific instruments would render other VA owned components and the recently purchased Davinci machine useless, making it necessary to purchase a new system which would be costly. This procurement is advantageous to the government as well as ensuring ultimate care for our patients. Est. $32,500. 4.Identification of the statutory authority permitting other than full and open competition. FAR 6.302-2 Unusual and Compelling Urgency 5.Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. Intuitive Surgical Inc is the only known source for the Davinci equipment and accessory items. These supplies are consistent with instrumentation and equipment currently in house. These specific items are compatible with the Davinci machine. 6.Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a Commerce Business Daily notice was or will be publicized as required by subpart 5.2 (copy attached) and, if not, which exception under 5.202 applies. N/A 7. Determination by the contracting officer that the anticipated cost to the government will be fair and reasonable. This is based on a full procurement that was done six months ago so the price has been determined to be fair and reasonable. 8.Description of the market survey conducted (i.e., names of firms and the date(s) the firms were contacted) and the results or a statement of the reasons a market survey was not conducted. These items are to be used specifically with equipment already on station. There is no other known source that provides the requested supplies. 9.Any other facts supporting the use of other than full and open competition, such as an explanation why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. These items are necessary to maintain compatibility in instrumentation and equipment. Not to use this specific supply item could increase cost as the instruments are used in conjunction with equipment already on station. To the best of my knowledge, there is no authorized dealer to distribute the DaVinci equipment and accessory disposable and reusable items. 10.A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. N/A 11.A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Allow sufficient time for A&MMS to solicit on the open market to determine other source of supply, if any.
