Department of MemorandumVeterans Affairs Date: 30 April, 2010 From:Hans Lorenzini, VA Heartland Network Contracting (10N15-90) Subj:Justification and Approval for Other Than Full and Open Competition IAW FAR 6.302-1 To:Contract File 1. IDENTIFICATION AND DESCRIPTION OF ACTION BEING APPROVED: This action is based on requirement for a Prosthetic Leg for a Veteran being serviced by the Poplar Bluff, VAMC and being procured in accordance with the Federal Acquisition Regulation (FAR). It is an sole source procurement under FAR 6.302-1 and VHA Handbook 11173.1 that states that eligible Veterans who have previously received artificial limbs, from commercial sources, will continue to have their choice of vendor son contract with the VA, or their non-contract Prosthetist providing Prosthestist accepts the VA preferred rate for the geographical area. For this area the preferred rate is Medicare allowable less 12.5% which is the average discount for the contract vendors. This Prosthetics provider offered this rate and the Veteran has an established relationship with the non contract Prosthetic provider. 2. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED: The contract is for the purchase of a prosthetic leg. The estimated value is $38,600.68. The expected contract recipient is a small business manufacturer of the equipment that will meet the requirement. The POC for this requirement is Mary Parker, Poplar Bluff, MO VAMC. 3. IDENTIFICATION OF STATUTORY AUTHORITY: The requirement will be solicited under citation 10 U.S.C. 2304(c)(2), 41 U.S.C. 253(c)(2) and FAR 6.302-1. Only one responsible source exists and no other supplies or services will satisfy agency requirements. 4. DEMONSTRATION THAT THE ACQUISITION REQUIRES USE OF AUTHORITY CITED: The requirement is essential to perform the mission of the Veterans Health Administration. J&A PAGE 2 5. DEMONSTRATION THAT THE ANTICIPATED COST WILL BE FAIR AND REASONABLE: The contractor will accept the VA preferred provider rate. 7.
