- Justification for Other Than Full & Open Competition Document This publication serves as notice of intent to procure services for the Department of Commerce (DOC), National Oceanic & Atmospheric Administration (NOAA), National Marine Fisheries Service (NMFS), Northwest Regional Office (NRO), Office of Law Enforcement (OLE) located in Seattle, WA, on a sole source basis with Archipelago Marine Research, Ltd. The Government intends to acquire the services indicated below using FAR Part 15. The National Marine Fisheries Service in Seattle, WA wishes to negotiate a sole source contract with Archipelago Marine Research, Ltd. of Victoria, British Columbia to provide and install Electronic Monitoring System (EMS) units on each vessel in the NOAA fleet. EMS involves the placement of tamper-proof automated computing systems, including cameras, aboard fishing vessels to independently monitor a variety of activities and to provide accurate, timely and verifiable fisheries data. Through the use of digital imagery, global positioning systems, and information from other on-board sensors, EMS provides a variety of fishery information including: fishing time and location; gear deployment and retrieval methods; catch and bycatch handling; and catch disposition. EMS has been successfully used to monitor compliance with catch retention and closed area requirements in the Pacific whiting shoreside fishery. Following are the EMS project services required: supplying an adequate number of EMS units (approximately 40) that meet the specifications and performance requirements necessary to monitor the Pacific whiting shoreside fishery, successfully installing the EMS equipment on vessels, maintaining the EMS equipment throughout the season with minimal system down time, reviewing and compiling EMS information for each vessel after the season, providing a final report to OLE and SFD on the effectiveness of the EMS, providing written outreach with the fishing industry before and during the season. The Government intends to negotiate a firm fixed price contract with the period of performance commencing on or about July 1, 2010. The NAICS code for this procurement is 541990 with a corresponding size standard of $7.0M. This notice represents the only official notice of this solicitation. This notice of intent is not a request for competitive proposals; however, all submittals received by the due date set forth in this notice will be considered by the Government. A determination by the Government not to compete this requirement based upon responses to this notice is solely within the discretion of the Government. It is the Government's belief that only Archipelago Marine Research, Ltd. can provide these services. However, other potential sources with the expertise and required capabilities to provide these supplies can submit such data discussing the same in duplicate within 10 days from the date of this announcement. This data must include sufficient information to allow NOAA to evaluate the proposal relative to the above requirements. No cost or pricing data is required.
