- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Organization: Department of Veterans Affairs, VISN 20, VAPSHCS. 2. Description of Action: This is a request for other than full and open competition for the procurement of Bioglue from Cryolife Inc, 1655 Roberts Blvd NW, Kennesaw, GA 30144-3632. 3. Description of Supplies or Services: Item is used in open heart surgery when closing aorta valve; helps prevent bleeding and seals anastomosis. 4. Statutory Authority: (x) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; ( ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5. Validity of Use of Statutory Authority: No other vendor makes or distributes this product and has U.S patent # 6,329,337. 6. Actions to Promote Competition: Contracting Officer will work with the OR to finds other sources that may be able to provide like or similar product. 7. Determination of Fair and Reasonable Price: In accordance with FAR 13.106-3(a)(2), price will be determined fair and reasonable with respect to previous purchases made. 8. Market Survey (FAR 7.102): Currently, there is no other vendor that makes this bioglue and when bioglue is ordered for our O.R. it is always on emergency basis for direct patient care in the O.R. 9. Other Considerations: Bioglue is needed to complete open heart surgeries. If bioglue is not made readily available, then patient care would negatively be impacted. 10.
