- Justification for other than Full and Open Competition GE Anesthesia Equipment John Cochran VA Medical Center St. Louis, MO 63106 The justification is being prepared to support the issuance of a solicitation for maintenance services to GE Healthcare (GE) under FAR 6.302-1 and 41 U.S.C. 253(c)(1) without providing for full and open competition. This solicitation and resulting contract will be to provide maintenance services and emergency repairs to AS/3 or CS/3 Central Units Anesthesia units at the Veterans Affairs Medical Center, St. Louis, MO. The equipment used in this contract requires factory hardware and replacement parts and proprietary diagnostic repair software that can only be obtained from GE. The contract will be for a base year and four option years. The estimated total value of the contract is $266,518.78. The activity ™s Biomedical Engineering Department ™s sole source justification has indicated that GE has proprietary rights to OEM parts and diagnostic software for this equipment, so they are the only qualified contractor. These systems are very complicated and must be serviced by qualified personnel with access to quality parts and required diagnostic tools. Harm to the government would occur if patient care were impacted by equipment failure and improper maintenance. In accordance with FAR 13.501(a)(2) [F]or a proposed contract exceeding $100,000.00 but not $550,000.00, the Contracting Officer ™s certification that the justification is accurate and complete to the best of the Contracting Officer ™s knowledge and belief will serve as approval, unless a higher approval level is established in accordance with agency procedures.
