- JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-1 Upon the basis of the following justification, I hereby approve the issuance of the Contractual action described below using other than full and open competition, pursuant to the authority cited herein. 1.Agency and Contracting Activity Department of Veterans AffairsVA Medical Center Network Heartland VISN 15800 Hospital Drive 4101 S. 4th St. TrafficwayColumbia, MO 65201 Leavenworth, KS 66048-5505 2.Description of Action Being Approved Proposed sole source procurement for three Arthroscopic sets. The estimated cost is projected to be $42,660.00. 3.Description of Supplies Required to Meet Agency's Needs The replacement parts must meet the exact specifications of the originals to be compatible in form, fit, and function. 4.Statutory Authority Permitting Other Than Full and Open Competition The authority permitting other than full and open competition in this instance is FAR 6.302-1 "Only one responsible source is available and no other supplies will satisfy agency requirements". 5.Rational Supporting Use of Authority Cited Above These are specialized instruments which have a low profile head for hard to reach areas and have unique shapes, sizes, and angles that are not found with other manufacturers. Confirmed by market research from Olympus, Karl Storz, and Linvatec the Arthrex instruments have wider tips, angles and handle styles that other vendors cannot provide. These instruments also match and work with the existing Artrex sets used at the Columbia, VAMC. 6.Efforts to Solicit Potential Sources The Columbia Station Inventory Manager has checked FSS, NAC, Medcompare, and Google websites and could not find any other vendors which sold that specialized type of instruments requested. 7.Determination of Fair and Reasonable Cost by Contracting Officer Cost to the Government is deemed fair & reasonable compared to similar instruments of this nature. 8.Market Research Market research was conducted by the Contracting Officer and there were no available items of these exact specifications available from FSS, NAC, Google or other available vendors that sell these exact type of instruments. 9.Other Facts Supporting Use of Other Than Full and Open Competition a.Arthrex is the only distributor and manufacture of the items. b.No other sources will meet the needs of the Columbia VAMC. c.Other sources will be evaluated or considered as they become available. 10.Listing of Sources That Expressed in Writing an Interest in the Acquisition N/A 11.Actions Planned to Overcome Barriers to Competition to Future Procurements Should there be other vendors that can provide the same items in the future will be considered. 12.Certification Technical Certification I certify that the facts and representations included herein which form the basis for the determination are accurate and complete to the best of my knowledge and belief. ____________//es_______________ __28 June 2010_ Hans Lorenzini, Contracting OfficerDate
