Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation number FCCRFQ100000QRD4 is issued as a request for quotation (RFQ). This procurement is being conducted under simplified acquisition procedures in FAR Part 13. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-42. This RFQ is issued unrestricted under NAICS code 519130. The size standard is $25 million. The following contract line item number (CLIN) is included in this RFQ: CLIN 0001: Provide Local Content on the Internet Data in accordance with paragraphs a through e below. 1 JB _ _______ Pricing: Vendors shall provide Firm Fixed Price (FFP) quotes. a. The Federal Communications Commission (FCC) is conducting a Quadrennial Review of its media ownership regulations. For this Quadrennial Review, the FCC requires data on Internet website visitation, on a market-by-market basis. This data will be provided to the FCC contractor that is selected to prepare a study for the FCC as part of the Quadrennial Review. For the purposes of this acquisition, the term "market" refers to the Designated Market Area (DMA). The Contractor shall provide data for the top 100 DMAs, based on the 2009-2010 rankings. (For a list of DMAs, see http://en-us.nielsen.com/etc/content/nielsen _dotcom/en_us/home/ measurement/tv_research.mbt.39577.RelatedLinks.13293.MediaPath.pdf) The Contractor shall, for each market for which data are furnished, provide a comprehensive list of websites, as described below, visited by members of Contractor's panel. The list shall include all websites that were visited by more than 5 panel members during the three-month time period of February-April 2010. The Contractor shall identify each website by, at a minimum, the following characteristics: subject category and subcategory (e.g., news/information category, weather subcategory) and relationship to commonly-owned websites (e.g., the Baltimore Sun newspaper is part of Tribune Newspapers, and the Tribune Company has websites in addition to those for newspapers). In addition to data at the website level, Contractor shall provide data aggregated to the subcategory and category levels. The Contractor shall provide the data described above for the three-month time period of February, March, and April 2010. The Contractor shall provide more than 300 panel members for each of the top 100 DMAs. The number of panel members for each DMA shall be calculated as the average over the three months of February, March, and April 2010. To be included in the calculation for a particular month, there must be some measured Internet usage by the panel member. b. For each market, Contractor shall provide, at a minimum, the following information for each website reported: the months over which the data are provided, the market name, the subject category and subcategory as specified above; the relationship to commonly-owned websites as specified above; total DMA unique visitors (including for the total Internet); DMA reach percentage (i.e., the projected percentage of total DMA online population visiting the website), national reach percentage (i.e., the projected percentage of the total United States online population visiting the website), a "site reach index," defined as the DMA reach percentage divided by the national reach percentage, total DMA minutes, page views, and visits; the raw number of panel visitors in the market, and the raw number of panel visitors in the total United States. Contractor shall also provide this information with respect to total Internet usage in each DMA and shall provide aggregate data at the category and subcategory levels. c. The Contractor shall also provide a list and definitions of all "variables" or "fields" that appear in each record of the dataset, along with definitions of all categories and subcategories used, and a description of the "hierarchy levels" used to describe the relationship among affiliated websites. A "record" is the set of data provided for a particular website, category, or subcategory (or for the total Internet) with respect to a particular market. Each record consists of a series of variables or fields, e.g., total unique DMA visitors. d. Data Rights: Notwithstanding any other term or condition in any attachment or addendum, the Contractor grants to the Government and the author selected to prepare a statistical study on the Government's behalf as part of the Quadrennial Review (the "Author"), subject to the Author's agreement to non-disclosure restrictions, a paid-up, nonexclusive, irrevocable, worldwide license to use the data delivered to the Government (the "Data") for the purposes of supporting the official business of the Government and the Author's academic work, but not for any commercial purpose. The Government and the Author may: (1) reproduce and distribute the Data internally and prepare derivative works for internal use; (2) publicly cite limited, insubstantial portions of the Data; (3) prepare and publish derivative works, including statistical analyses, that utilize the Data but do not include publication of the underlying Data, with appropriate citation to the source; and (4) release the Data to a federal court if directed by a court order. In addition, during the pendency of the FCC's Quadrennial Review proceeding, the Government may make available to the public and the peer reviewers for the study, for the sole purpose of evaluating the Author's study, compiled data sets prepared by the Authors that include the some or all of the Data, subject to the following limitations: compiled data sets shall be made available to peer reviewers subject to the terms of a non-disclosure agreement, which shall prohibit use of the Data for any commercial purpose; and compiled data sets shall be made available to the public for the sole purpose of allowing members of the public to comment upon the Author's study and subject to the terms and conditions of an FCC protective order, which shall prohibit use of the Data for any commercial purpose. Except to the extent expressly stated herein, the above data rights shall continue indefinitely with respect to the Data. e. The data described above shall be delivered to the FCC within two (2) weeks of the issuance of a purchase order by the FCC. Provision at 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition with the following addenda: Vendors are requested to demonstrate their expertise through a written quotation. Quotations shall include the following information: Technical Factor: Vendors shall address the data and delivery requirements stated in paragraphs a through e above. In particular, vendors shall provide the number of panel members for each DMA as well as the combined total number of panel members for all 100 DMAs. The number of panel members for each DMA shall be calculated as the average over the three months of February, March, and April 2010. To be included in the calculation for a particular month, there must be some measured Internet usage by the panel member. Vendors must include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items, with their quotations. Vendors shall submit their quote via email to: Bridget.Gauer@FCC.gov no later than the response date stated in this notice. Please ensure you put the solicitation number in the subject line of the email. The Government will make an offer to the vendor whose quotation conforms to the requirements of this solicitation and is most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotations: Technical and Price. These factors are of approximately equal importance. For the Technical Factor, the Government will evaluate each vendor's combined total number of panel members for all 100 DMAs for the three month period of February-April 2010. Clause at 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition with no addendum. Paragraph (s) of 52.212-4 is tailored as follows: (s) Order of precedence (Tailored). Any inconsistencies in this solicitation or contract shall be resolved by giving precedence in the following order: (1) the schedule of supplies/services; (2) the Assignments, Disputes, Payments, Invoice, Other Compliances, and Compliance with Laws Unique to Government Contracts paragraphs of this clause; (3) the clause at 52.212-5; (4) addenda to this solicitation or contract, except as set forth in (10) below; (5) solicitation provisions if this is a solicitation; (6) other paragraphs of this clause; (7) the Standard Form 1449; (8) other documents, exhibits, and attachments; (9) the specification; and (10) the Contractor's quotation, if incorporated in full text or by reference, and any Contractor license agreement. Clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition and the following additional FAR clauses cited in the clause are applicable to the acquisition: 52.219-28, 52-222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-36, 52.225-1, 52.225-13, and 52.232-33. The Contractor shall submit invoices in accordance with the FCC invoice procedures below: INVOICES NOTE: *Invoices may be submitted via email to: FO-Einvoices@fcc.gov. In addition, copies of the emailed invoices shall also be sent to the CO. Only one emailed copy is required.
