- Signed Sole Source Justification JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION JOFOC # DTFR53-10-006 1) Contracting Activity. This justification for other than full and open competition is made by the Office of Policy, Federal Railroad Administration (FRA), United States Department of Transportation, pursuant to the requirements of Federal Acquisition Regulations. 2) Nature of Action. The aforementioned contracting activity proposes to issue procurement request/purchase order to purchase software maintenance from Environmental Systems Research Institute, Inc. (ESRI). There is an additional purchase of ArcGIS Server, so that FRA can mimic the GIS web environment on an intranet server to serve internal/sensitive data to FRA inspectors. The maintenance covers technical support and updates for the ESRI suite of Geographic Information System (GIS) software, which is part of the FRA's Enterprise Architecture. 3) Description of Supplies/Services. The FRA GIS Program relies on the GIS software suite produced by ESRI. The ESRI software is an integral part of the FRA Enterprise Architecture. FRA already has legacy systems and applications based on the ESRI software and continue to develop geospatial data and applications using the ESRI software. FRA's Office of Policy uses ArcView, ArcGIS, ArcSDE, and ArcServer to develop and maintain the GIS applications and databases. ESRI charges an annual maintenance fee for their software, which covers technical support and product updates. ESRI is the sole manufacturer of their software suite, and the sole provider of maintenance for their software suite. The proposed purchase order has an estimated value between $25,000-$33,000. The period of performance for this action is 08/26/2010 through 08/25/2011. 4) Statutory Authority. The statutory authority permitting other than full and open competition is the Federal Acquisition Regulation (FAR) 6.302-1, (a), 2, (i). In accordance with 41 U.S.C 253(c) and FAR Subpart 6.302-1, USDOT has no other option for purchasing maintenance for the ESRI software suite. ESRI is the sole manufacturer of their software suite, and the sole provider of maintenance for their software suite. 5) Efforts to Select Potential Sources. This procurement is for software maintenance. The effort to select potential sources was conducted by FRA staff. 6) Determination of Fair and Reasonable Cost. USDOT will determine that the proposed cost is realistic, fair, and reasonable. 7) Market Survey. The proposed contractor is the only available source for these services. 8) Additional Support. None. 9) Other Interested Sources. None 10) Future Competitive Plans. Although the Government will continue to evaluate on an ongoing basis, any interest shown by sources interested in competing for this requirement on subsequent acquisitions, it is not expected that any vendor other than ESRI will be able to provide maintenance for the ESRI software suite.
