- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, in conjunction with FAR 13.5, as applicable, and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; bids are being requested and a written solicitation will not be issued. The solicitation number is E011121 and is issued as an invitation for bids (IFB), unless otherwise indicated herein. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-44. The associated North American Industrial Classification System (NAICS) code for this procurement is 334611 with a small business size standard of 500.00 employees. This requirement is a [ Small Business ] set-aside and only qualified offerors may submit bids. The solicitation pricing on www.FedBid.com will start on the date this solicitation is posted and will end on 2010-08-27 14:00:00.0 Eastern Time or as otherwise displayed at www.FedBid.com. FOB Destination shall be Quantico, VA 22135 The Federal Bureau of Investigation requires the following items, Exact Match Only, to the following: LI 001, EXTENDED MAINTENANCE SUPPORT FOR IXVOICE SOFTWARE PRODUCTS BY IXIA, 1, YEAR; LI 002, EXTENDED WARRANTY SUPPORT FOR IXVOICE HARDWARE PRODUCTS BY IXIA, 1, YEAR; Solicitation and Buy Attachments ***Question Submission: Interested offerors must submit any questions concerning the solicitation at the earliest time possible to enable the Buyer to respond. Questions must be submitted by using the 'Submit a Question' feature at www.fedbid.com. Questions not received within a reasonable time prior to close of the solicitation may not be considered.*** For this solicitation, Federal Bureau of Investigation intends to conduct an online competitive reverse auction to be facilitated by the third-party reverse auction provider, FedBid, Inc. FedBid has developed an online, anonymous, browser based application to conduct the reverse auction. An Offeror may submit a series of pricing bids, which descend in price during the specified period of time for the aforementioned reverse auction. Federal Bureau of Investigation is taking this action in an effort to improve both vendor access and awareness of requests and the agency's ability to gather multiple, competed, real-time bids. All responsible Offerors that respond to this solicitation MUST submit the pricing portion of their bid using the online exchange located at www.FedBid.com. There is no cost to register, review procurement data or make a bid on www.FedBid.com. Offerors that are not currently registered to use www.FedBid.com should proceed to www.FedBid.com to complete their free registration. The provision at 52.212-5, "Contract Terms and Conditions Required to Implement Statutes or Executive OrdersCommercial Items" is attached to the solicitation for offerors to complete. Bid MUST be good for 30 calendar days after close of Buy. Shipping must be free on board (FOB) destination CONUS (Continental U.S.), which means that the seller must deliver the goods on its conveyance at the destination specified by the buyer, and the seller is responsible for the cost of shipping and risk of loss prior to actual delivery at the specified destination. Mandatory Offeror must be registered in the Central Contractor Registration (CCR) database before an award can be made to them. If the offeror is not registered in the CCR, it may do so through the CCR website at http://www.ccr.gov. The selected Offeror must comply with the following commercial item terms and conditions, which are incorporated herein by reference: FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items - the selected offeror must submit a completed copy of the listed representations and certifications; FAR 52.212-4, Contract Terms and Conditions - Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, paragraph (a) and the following clauses in paragraph (b): 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-13, 52.232-34. (2) AN AWARD WILL BE MADE TO THE VENDOR THAT CAN PROVIDE ALL ITEMS. (3) The evaluation criteria for this RFQ will consist of delivery, technical capability, and price. (4) Past performance and price are of equal importance. All other evaluation factors are significantly less important than price combined, and individually. The solicitation document and incorporated provisions and clauses are those in effect through FAC 2005-36 Effective August 11, 2009. 52.232-8 DISCOUNTS FOR PROMPT PAYMENT (FEB 2002) a.Discounts for prompt payment will not be considered in the evaluation of offers. However, any offered discount will form a part of the award, and will be taken if payment is made within the discount period indicated in the offer by the Offeror. As an alternative to offering a discount for prompt payment in conjunction with the offer, Offerors awarded contracts may include discounts for prompt payment on individual invoices. b.In connection with any discount offered for prompt payment, time shall be computed from the date of the invoice. If the Contractor has not placed a date on the invoice, the due date shall be calculated from the date the designated billing office receives a proper invoice, provided the agency annotates such invoice with the date of receipt at the time of receipt. For the purpose of computing the discount earned, payment shall be considered to have been made on the date that appears on the payment check or, for an electronic funds transfer, the specified payment date. When the discount date falls on a Saturday, Sunday, or legal holiday when Federal Government offices are closed and Government business is not expected to be conducted, payment may be made on the following business day. (b) Any bid that does not conform to the applicable specifications shall be rejected unless the invitation authorized the submission of alternate bids and the supplies offered as alternates meet the requirements specified in the invitation. (c) Any bid that fails to conform to the delivery schedule or permissible alternates stated in the invitation shall be rejected. A condition goes to the substance of a bid where it affects price, quantity, quality, or delivery of the items offered. (f) Any bid may be rejected if the contracting officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only the total price of the bid, but the prices for individual line items as well. (g) Any bid may be rejected if the prices for any line items or subline items are materially unbalanced (see 15.404-1(g)). (h) Bids received from any person or concern that is suspended, debarred, proposed for debarment or declared ineligible as of the bid opening date shall be rejected unless a compelling reason determination is made (see Subpart 9.4). (i) Low bids received from concerns determined to be not responsible pursuant to subpart 9.1 shall be rejected (but if a bidder is a small business concern, see 19.6 with respect to certificates of competency). In no event shall any understanding, agreement, contract modification, changeorder, or other matter made between the Contractor and a person other than theContracting Officer in deviation from the terms of this contract be effective orbinding upon the Government. The Contracting Officer is the only personauthorized to make or approve any changes in any of the requirements of thiscontract and, notwithstanding any provisions contained elsewhere in this contract,the said authority remains solely with the Contracting Officer. In the event thatthe Contractor makes any changes at the discretion of any person other than theContracting Officer, the change will be considered to have been made withoutauthority and no adjustment will be made in the contract price to cover anyincrease in the costs incurred as a result thereof. 52.216-1 TYPE OF CONTRACTTYPE OF CONTRACT (APR 1984)The Government Contemplates award of a Fixed Price Purchase Order resulting from this solicitation.(End of clause) To be considered for award, all sellers must be manufacturer authorized distributors of the equipment/services they are offering. Sellers will be required to provide documentation as proof of authorization to be considered for award.
