- INTENT TO AWARD A SOLE SOURCE. It is the intent of the Department of Health & Human Services (HHS)/Program Support Center (PSC) to award a sole source simplified acquisition on behalf of the Office of the Assistant Secretary for Administration/Office of Diversity Management and Equal Employment Opportunity (EEO) for the acquisition of licenses for 200 HHS EEO Counselors and practitioners to take four courses. The simplified acquisition shall be awarded to LRP Publications, the exclusive publisher and sole provider of cyberFEDS eLearning, a web-based interactive management training system. The interactive training shall consist of informational overviews of federal employee roles, rights and responsibilities as derived from Federal anti-discrimination statues and regulatory guidance. Pursuant to EEO regulations found at Title 29 Code of Federal Regulations Part 1614.102(a)(11), each federal agency is required to develop and conduct EEO training for supervisors, managers and employees. With regard to EEO Counselor and practitioner training, EEOC Management Directive 110 specifies all Counselors and practitioners are required to receive at least eight hours of continuing training every year to keep them informed of developments in EEO practice, law, and guidance, as well as to enhance and develop counseling skills. LRP Publications shall make their website that houses the required training available not later than 60 days after award and continuing for one year. The Contractor shall also provide administrative tracking and monitoring capabilities that facilitate a trained administrator to track, monitor and assess relevant statistical data associated with course completion, efficiency of any interactive learning tools, i.e., periodic/end-of-course quizzes or exams, and other relevant administrative management processes. The Contractor shall make available personnel, training modules that overview, federal civilian employee roles, rights, and responsibilities in accordance with federal EEO statutes and guidelines. The relevant statutes encompass the full spectrum of anti-discrimination laws that direct the management and environment of the federal workplace, including but not limited to: The Civil Rights Act of 1964, Civil Rights Act of 1991, Rehabilitation Act, Age Discrimination in Employment Act, Notification and Federal Employee Antidiscrimination and Retaliation Act of 2002, to include landmark U.S. Supreme Court Decisions. Courses shall contain capability for interruption/section breaks during the training process at appropriate intervals. The web-based program shall provide the ability to complete an interrupted training module without having to re-accomplish completed sections. Each course shall be offered in a web-based environment. All web-based training material shall be made available in all adult learning modules that may be customized for HHS. LRP Publications is the exclusive publisher and sole provider of CyberFEDS, which has proprietary knowledge of their management training system. HHS has been utilizing cyberFEDS as a research tool for EEO professional since 2001. The Government knows of no other source able to provide this training consisting of legal and regulatory information for federal employment law and HR professionals which satisfies the needs of the agency. Interested concerns may identify their interest and submit a capability statement that demonstrates their ability to provide the services required. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. NO SOLICITATION IS AVAILABLE; therefore, requests for such document will be considered invalid responses. This acquisition is being conducted under FAR Part 13, Simplified Acquisition Procedures, and is exempt from the requirements of FAR Part 6, Competition Requirements. The North American Industry Classification (NAICS) Code is 519130 and the Size Standard is $7.0M. The determination by the Government not to compete the proposed purchase order based upon responses to this notice is solely within discretion of the Government. This action is under the authority of 41.U.S.C.253(c) (1), as set forth in FAR 13.106-1(B) (2). If no affirmative responses are received within seven days from the date of this synopsis, the Contracting Officer will proceed with the award to LRP Publications, 360 Hiatt Drive, Palm Beach Gardens, FL 33418-7106.
