- This contract action was accomplished using other than competitive procedures because a statute exists that expressly authorizes or requires that the acquisition be made from a specific source or through another agency (FAR 6.302-5); specifically, Sole source awards under the 8(a) Program. Per FAR 6.302-5 a J&A is not required for this award. The work of this project consists of the reconstruction of the eroded embankment along the right side of the Edward MacDowell outlet works channel, in Peterborough, New Hampshire. The work includes restoration of drainage swales, planting grass on the slope which has recently been cleared of trees, removal of four stumps, and repairing erosion damage. The upper swale restoration includes clearing and grading the base to ensure drainage without ponding, and rebuilding its lower berm as necessary to provide two feet of height above the base of the swale. The lower swale shall be cleared of debris and sediment. Restoration shall include the repair of about a 200 cubic yard erosion hole in the lower embankment located between about 30 to 80 feet from the edge of the outlet works channel and a turf bench, and several smaller eroded sections and stump holes totaling an estimated 20 cubic yards above the bench. The section of the embankment below the bench is armored with stone and will not require planting. Erosion damage was caused by an intermittent stream overtopping the drain at the top of the embankment. The intermittent stream shall be diverted and armored to lower its angle of incidence with the drain. The drain shall be cleared of obstructions and re-graded where damaged. The work also includes restoration of a grassed roadway on the mid-slope bench. The eroded portion of the shoulder for the roadway shall be replaced with crushed aggregate. The grassy section above the bench shall be protected with an erosion control mat and seeded. The stone slope below the bench will be restored with crushed aggregate and crushed stone. Armor stone adjacent to the large erosion hole on the lower slope shall be salvaged and spread over the repaired section to mask the repaired section.
