- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, VISN 1, 523 - VA Boston Medical Center 2.Description of Action: This is a request for other than full and open competition for the procurement of a Tri Carb 2910 TR. 3.Description of Supplies or Services: The Tri Carb 2910 TR is required to perform incoming radioactive package surveys as required by regulation. Also, it is the only instrument able to detect radioactive tritium, use by VA Boston researchers. Safety staff cannot properly oversee lab safety nor can Safety staff perform regulatory required "close out" surveys of areas where radioactive material was formerly used without this instrument. 4.Statutory Authority: FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. ( X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; ( ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5.Validity of Use of Statutory Authority: This vendor is the developer and sole distributor of this product. It is in the best interest of the Government to purchase this couch top because it is needed the safety staff to properly oversee lab safety. (FAR 16.505(b) (2) Exceptions to the fair opportunity process) that the government use this vendor to purchase this couch top. Perkin Elmer is the proprietary owner of the Tri Carb 2910 TR and is the only vendor who can supply it. An intent to sole source was posted on FBO and no other vendor responded stating they could supply the requirement. 6.Actions to Promote Competition: An intent to sole source was posted on FBO and no other vendor responded stating they could supply the requirement. Research was also performed to find out if other vendors were available. The following vendors were contacted, however were unable to provide these services. a.Beckman Company stopped making these counters a year ago. They will only provide support to existing units for 4 more years. b.Packard formerly made these units, but the company was bought out by Perkin Elmer. c.Perkin Elmer Company is the only US vendor of multi sample liquid scintillation counters currently manufacturing them. 7.Determination of Fair and Reasonable Price: The anticipated price to the Government is $35,670.00 to include the following items: 1.Tri Carb 2910 TR 2.Ambient Kit, Tri Carb VE 3.HP Laserjet Printer Kit 110V 4.Utility Cart (Assembled) 5.New Instrument Online Training and Support 6.Extended Warranty 8.Market Survey (FAR 10): In accordance with FAR 10.001 market research was conducted to find out if other contractors offer the same type of product. An intent to sole source was posted on FBO and no other vendor responded stating they could supply the requirement. The research yielded only Perkin Elmer as the only possible source. 9.Other Considerations: N/A 10.Listing of Sources that expressed, in writing, an interest in the acquisition: An intent to sole source was posted on FBO and no other vendor responded stating they could supply the requirement. 11.Statement of Actions to Overcome Barriers to Competition: N/A 12.Requirements Certification: I certify that the requirement outlined in this justification is a bonafide need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
