Description
The Department of Veterans Affairs, VA Boston Healthcare System intends to solicit, negotiate and award a sole source contract with Partner ™s Healthcare Brigham & Womens Hospital, an affiliate. This procurement is being conducted in accordance with FAR Part 6.302-5 Authorized by Statute and Public Law 108-18. A justification for other than full and open competition has been prepared in support of this acquisition. This procurement is for consultative services for selected cytopathology and surgical pathology cases and selected clinical laboratory tests (both technical and professional components). This notice of intent is not a request for competitive quotes. The Government shall consider all proposals received by 12:00 PM Eastern Standard Time October 25, 2010. The submission of any data for review shall not impede award of this contract as planned. Information received shall be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. No telephone inquiries shall be accepted. Information can be sent to the Department of Veterans Affairs via email at Tracey.Bissonnette@va.gov. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of the agency and the contracting activity. VA BOSTON HEALTHCARE SYSTEM Procurement for: Consultative services for selected cytopathology and surgical pathology cases and selected clinical laboratory tests. 2. Nature and/or description of the action being approved. SOLE SOURCE PROCUREMENT FOR: Partners Healthcare System: Brigham and Women ™s Hospital 3. Description of the supplies or services required to meet the agency's needs (including the estimated value).Please include the IFCAP transaction number, dollar value and a description of the item being sought. IFCAP Transaction # 523-11-1-2765-0031 Dollar value: $161,000 per year, $13,417/ MONTH Reagent cost: non applicable Item Description: Consultative services in cytopathology and surgical pathology and selected tests in clinical pathology. See statement of work of description of services 4. Identification of the statutory authority permitting other than full and open competition. FAR 6.302-5(a)2 Authorized or Required by Statute, VA Healthcare Resources Sharing Authority Law Title 38 USC 8151-8153 FAR 6.302-1, USC 253(c)(1)Only one Responsible Source 5. Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority sited. Brigham and Women ™s Hospital is the academic affiliate of VA Boston. They have pathologists that are experts in kidney and muscle pathology For clinical pathology testing: Factor VII, B Cell Total, T Cell Total, Asbol CD4 and CD8, Natural Killers, Flow Cytometry Tech, Platelet Aggregation, Ristocetin and Thrombin Time- these tests are time sensitive and must be performed STAT. Quest Diagnostics does not perform STAT at their Cambridge location therefore cannot meet STAT turnaround time requirements. For Anatomic pathology and cytopathology consultative services: Mainly muscle, skin and kidney biopsies that must be rec ™d immediately after biopsy to preserve integrity of specimen. Brigham and Women ™s Pathology Department is the academic affiliate to the West Roxbury VA Pathology Department. Electron Microscopy is needed on many of these specimens, which is not offered by Quest Diagnostics. 6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a FedBizOpts notice was or will be published. Consulted with Quest Sales Rep to verify that clinical pathology testing requirements could not be met by Quest. Brigham and Women ™s Hospital is the academic affiliate of VA Boston. The procurement will not be posted prior to award because an exception at FAR 6.302 applies. In accordance with FAR 6.302-5(a)2 Authorized or Required by Statute, this procurement is under VA Healthcare Resources Sharing Authority Law Title 38 USC 8151-8153 7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The proposed price for individuals with this level of education, expertise and related experience is fair and reasonable. 8. Description of the market survey conducted (i.e., names, of firms and the date(s) the firms were contacted) and the results or a statement of the reasons a market survey was not conducted. Consulted with Quest Sales Rep to verify that clinical pathology testing requirements could not be met by Quest. 9. Any other facts supporting the use of other than full and open competition, such as an explanation why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. Brigham and Women ™s Hospital is the academic affiliate of VA Boston. They have pathologists that are experts in kidney and muscle pathology. Also see number 5. 10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. None to date 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. This contracting activity will continue to encourage full and open competition whenever possible.
