- U.S. Army Research, Development and Engineering Command intends to solicit on a sole source basis under the statutory authority permitting Other than Full and Open Competition 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements to any contractor that can supply the following Xenonics Inc. Brand Name items: NightHunter 3 Shield Mount Upgrade Kits (Xenonics Part Number NH3-6100), NightHunter Battery Packs (Xenonics Part Number NH3-6229 ), and NightHunter Lamp Modules (Xenonics Part Number NHX-6230). This notice of intent is not a request for proposals or quotations. A sources sought notice was previously posted under this solicitation number and to date no responses other than the Xenonics brand name and Xenonics brand name distributors have been received. Requests for copies of a solicitation in response to this notice will not be honored or acknowledged. A determination by the Government not to compete this proposed action for other than the brand name items based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether conducting a non brand name competitive procurement is in the best interest of the Government. Interested parties may identify their capabilities by responding to this requirement, no later than 8:00am EST, 22 November 2010. All information submitted should support the offerors capability to provide the items required, and shall be furnished at no cost or obligation to the Government. Responses must be in writing and must provide clear and concise documentation indicating an offerors bona fide capability to provide these items. Verbal responses are not acceptable and will not be considered. Responses may be submitted via email if the total file size is less than 5MB. Otherwise, responses must be submitted via hard copy to: US Army RDECOMCC, AMSRD-ACC-BB (Moyer), 4118 Susquehanna Ave., APG, MD 21005. NOTE: Vendors that are able to supply the brand names items shall continue to watch this solicitation number for a brand name specification solicitation to be posted.
