- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION DEPARTMENT OF VETERANS AFFAIRS MEDICAL CENTER NEBRASKA-WESTERN IOWA HEALTH CARE SYSTEM DATE: January 7, 2010 PROJECT TITLE: 10th Floor PICU Heat - Omaha VAMC SOLICITATION: VA-263-11-RP-0133 CONTRACTOR: Winn Construction Company 15018 A Circle Omaha, NE 68144-5558 GOVERNMENT ESTIMATE: $77,000.00 PROJECT DESCRIPTION: The Department of Veterans Affairs Medical Center, Omaha, NE, requires the replacement of the existing induction units with fan coil units located on the 10th Floor of the "F" Wing of the Main Hospital (Building 1). Loss of heat has forced closure of the wing, forcing a loss in the capacity of the hospital to provide in-patient care to veterans. AUTHORITY FOR SOLE SOURCE JUSTIFICATION: FAR 6.302-5(b)(6), Authorized or required by statute. JUSTIFICATION 38 U.S.C. 8127 provides authority to the Department of Veterans Affairs to engage in sole source acquisitions with Service Disabled Veteran Owned Small Businesses (SDVOSB) and Veteran Owned Small Businesses (VOSB). Per FAR 5.202(a)(4), a synopsis is not required. Winn Construction Company is listed online at vetbiz.gov and has been verified by the Center for Veterans Excellence; no additional market research was conducted. Winn Construction Company is an experienced healthcare facility construction contractor with the experience, equipment, and personnel and stable of subcontractors to satisfactorily accomplish this project in a timely and cost effective manner. In addition, they have an established track record of providing competitive bids on previous projects below the Government Estimate and their competitors for similar size and larger projects. APPROVAL This procurement action is necessary and I certify that this justification is accurate and complete to the best of my knowledge and belief.
